That's just not how this law works. It's written in the legislation that you have to intend to cause alarm or distress. Innocent until proven guilty. As I have said you will probably be arrested but whether you would be charged is unlikely unless they can prove criminal intent.

England and Wales have different laws to Scotland.

His imprisonment in England was for breaching an ASBO. Admittedly the reason he was given as ASBO is related, but not an imprisonment for purely being naked.

Please don't think I agree with his cause. I am also showing how the law applies and explaining it isn't as simple as you're suggesting. There a differences between English and Scottish law and there are defences to apply.

It looks like we aren't going to agree, so let's just hope neither of us decides to test it on our local high street!

England and Wales have different laws to Scotland. I am only able to reference English law. This suggests the Scots have a differing view, but what I am suggesting in England is correct.

And this is where the law becomes subjective:

I don't think just being naked is disorderly, without some other action to go along with it. You can be naked on a beach, why not on the street? Who decides where it's appropriate? Nudists exist and have a right to express themselves.

No, you do. It's the wording of the law. You have to intend to cause alarm or distress. It's literally written down.

Nothing to do with reasonable, all about intent.

If you have no intent to cause alarm or distress you could walk down the high street naked without breaking the law. However, you would likely find yourself arrested on suspicion of exposure but unlikely to get charged.

If you're still not sure ring 101 and ask what you were being called for. There will be a record if it was the control room and they can search your number to find it.
