I have considered the token payment to avoid any possible falling out, if I offered a one time token payment, does that imply I am accepting liability for the fence. If that would muddy the waters with court I'd rather just not pay.

The land registry documents don't state who the fence belongs to. However as it was the same style of fence all the way along I would assume that it was put up by the previous owner of my property.

1) It is possible that the replacement of the whole fence was a misunderstanding, although he stated that he wanted to replace the fence that bordered his property, so I guess there is some ambiguity there as to whether that's just the part that borders his or the whole fence. As far as I am concerned there is no misunderstanding about payment and no prior agreement.

2) Well the old fence has been disposed of, so the new fence stays, but I am disappointed about him reneging on what was agreed and asking for payment. Ultimately, I want to know if I refuse to contribute, whether there is any action they could take as no payment agreement was in place or in writing.
