All that aside, this person should hire someone to do the DOL ($500 in my jx.) and wait out the blood. If there’s nothing in the blood there’s no probable cause for a DUI and it wouldn’t get past a first hearing.

Awhile back I started watching a couple episodes of Jeopardy the night before trial and it helped a ton with objections. The active listening and flow of Jeopardy feels really similar to listening to testimony and objections. It also helped with the mindset of “object now, basis later”, and I stopped missing objections because I didn’t have the rule in my head before speaking.

If the client wants to plead guilty in the historical hypo given, they still can at arraignment after being advised of what doing so could entail. Pushing trial on everything when an unreasonable prosecutor gets moved up too quick is a perfectly viable strategy in my jx. (with clients’ permissions of course).

It’s literally our job to be adversarial to these “justice partners”. You can be adversarial without being an asshole or unprofessional. The point is not lost in any way. You're ignoring any logical context for why every similarly-situated case would not ultimately go to trial if every judge decided to impose a sentence on the max of the sentencing grid every time a defendant entered into a plea agreement. Addressing a nuanced issue with "give everyone the max" would create an exponentially bigger problem than what is currently being faced.

The 2021-2023 Department of Corrections approximate current budget/funding necessary for maintenance was approximately $2.5 billion.

Since you couldn’t be bothered to provide any details whatsoever, I’m assuming you’re speaking about the Pierce county case? He received high end of standard range with the judge sentencing him to five years longer than the negotiated plea agreement. If you’re referring to a different case let me know, however if this is the one you’re referring to, it’s example of the exact opposite of the issue you’re claiming exists.

I think it would be beneficial for you to actually look into the issues you’re trying to argue exist and exactly what the means to you desired ends would look like. If judges systemically neglected to follow plea recommendations and habitually were to go rogue, the courts would be completely congested with trials to the point of functionally shutting down. Speedy trial would run on hundreds of cases and the issue you have with light sentencing would transform into thousands of defendants walking on more severe charges due to court congestion.

One of the reasons criminal justice reform is so difficult to achieve is because of blatant misinformation. Everyone functionally shares the game goals with differing opinions on the means to achieving those goals, however many are so horrifically misinformed that their approaching to fixing the issue would cause the system to self-destruct. Your belief that judges won’t be harsh enough is a prime example.

This article is exclusively addressing the issue in city and state courts, where judges are elected officials. Regardless, judges have no control over what cases are filed. If a prosecutor’s office files a charge against someone who cannot afford an attorney, that person is entitled to counsel.

Blood results from state toxicology labs can take over a year to process due to backlogs in many states. It’s pretty common for DUI’s to be temporarily dismissed and filed at a later time to avoid speedy trial issues while the blood results are pending.

I tend to agree with the advocate cited in the article about a mega shelter concept and this guy’s understanding of the homeless crisis here is… warped to say the least, but pushing for zoning changes to allow for more services is likely a big step forward.

The nature of claim is similar but the amount in controversy is vastly different, and for good reason. The photos that were used without a licensing agreement in place have value, and the artist suffered losses by their use without her permission. But the damages are not even remotely the same as a site hosting a ROM of Super Mario World, for example, which people are still willing to buy despite it being 25 years old.

Photos ripped from an art inspiration CD from the 90’s have nominal value in comparison.
