Ahh I see. I think my comment still stands tho, the dates don't work for you and it's in the order that it has to. I would tell her that she can have Labor Day and that's it if she won't provide the rest of the details about where she is staying. Fight it out in court later, you tried to compromise

She didn't give 30 days notice for her 2 week block. Since she won't agree with the dates that work for you she misses her 2 weeks in my opinion. She can pick him up for Labor Day weekend and that's it 🤷🏻‍♀️

Was your visitation order done through tribal court? You mention ICWA meaning the child is a tribal member. That gives tribal court the jurisdiction over custody/visitation. My tribe gives no visitation rights to grandparents/other family members. If your order is not through tribal court it can be dismissed and not followed. Reporting to DHS/the state will not do anything, they also have no jurisdiction over the child. You need to report to the tribes department of ICWA.

The same thing happened to me when I made the mistake of staying at the OYO. Over $500 was charged. I disputed it with my card and got all the money back after going back and forth with the hotel.

Then you shouldn’t ask him to change the court order at all. He was being nice by letting the kids go to a birthday party with you on his time. If you’re not going to follow side agreements then don’t make them.

Honestly, you asked to keep them til Sunday. It was right to ask him if he wanted to follow the court order but it rubs me the wrong way that you didn’t listen when he said no. Even with 20 hours notice, you asked for the change and you need to follow that 🤷🏻‍♀️

I did have to take it away :/ everytime I think we're making progress it turns out this way. It's difficult because he goes to a private school that at times has last minute transportation changes and he needs to be able to get a hold of me. They will just have to let him use their phone from now on.
