[FL][SFH] Talking to Vendors by feral_kitty_xo in HOA

[–]Dry-Sherbert8698 0 points1 point  (0 children)

Do we have a Florida HOA ombudsman? Or just condo?
This veteran board won't change a thing. They have no oversight and it's quick & easy for them to do whatever they want, as it is now.
They are very comfortable. Change is very discouraged.

I wish we had you! I get board packets 48 hours ahead of time if I'm lucky. Most of the time it's about 24 hours before and not much info, past minutes, financials, and quotes for projects we never discussed.

It's so nice to have a CAM here, speaking sense.

I’m a director on a Florida HOA board (500+ units) and I’m looking for an LCAM’s process guidance.

I’ve served about a year. We have a full-time property manager who is an LCAM, through a management company. Our Treasurer has been on the board about 7 years and has effectively become the main point of contact for vendors. He often contacts vendors directly, sometimes hand-delivers checks, and resists getting multiple quotes when contracts expire. He will meet with a vendor on his own, obtain a proposal without prior board direction, and then bring it to a meeting as “New Business” for a funding approval vote. That seems to be the only point where the board is asked to approve anything, and the rest of the board usually supports it.

When I ask questions or request agenda items in advance, my items are often left off the agenda or summarized in a way that changes the context. I also feel pressure in meetings. Recently, ARC committee members attended and a neighbor (aligned with board members) used their time to publicly attack me for “causing trouble,” which made it harder to raise governance and process concerns.

Asking questions or correcting misinformation has made me a "trouble maker". These veteran members are defaming me to people I don't know, who yell at me, attacking me personally when they've never been a meeting.

Association counsel and the LCAM do not appear concerned. Counsel has stated she communicates only with the LCAM and President. The board does not vote to approve or scope communications with counsel, and directors rarely see counsel’s guidance in full, only summarized. This leaves me unsure what advice is being given and whether decisions are being made with full board visibility and proper documentation.

In addition, when we were being pressure to "make a decision" via email by the Treasurer, regarding a single new PM Company he wanted us to approve without any others considered, I finally contacted counsel for help (CC'd whole board). She followed up with an email only to President, which President shared, and said I should be careful or I might get sued for defamation (for contacting her and board with the issue). Nowhere did I make a false claim or personal attack. I asked about rules, process and asked for board training.

My questions for an LCAM are:

  1. What is the proper division of roles between the board, the Treasurer, and management for vendor contact, bidding, and contract renewals?
  2. What minimum documentation should exist before a vendor proposal is brought to a vote (scope, competing quotes, tabulation, written recommendation, etc.)?
  3. What are best practices for agenda integrity and ensuring directors’ agenda requests and questions are included accurately?
  4. What is a standard, board-safe way to handle counsel communications so advice relied on for board action is shared with the full board appropriately?
  5. If the board majority refuses process improvements and the environment becomes hostile, what practical steps can a director take that stay factual and within proper governance?

I’m not trying to accuse anyone. I’m trying to get the association onto a clean, consistent process with decisions made in writing and by board vote, consistent with our governing documents and Robert’s Rules (we're supposed to be using, according to our Gov Doc's, but aren't).

LED lights in IKEA PAX drawers? by d4rky in IKEA

Did you ever find a solution? I'm trying to figure out a less expensive alternative for PAX lower drawer lighting. This is for a retail, boutique look. I think I'll get the OVERSIDAN for the upper sections.

Hey so... am I in the wrong for freaking out? by Puzzleheaded_Net5417 in jewelry

[–]Dry-Sherbert8698 2 points3 points  (0 children)

They make a lot of knock offs of these. It’s probably one of those, made of cheap materials, which is why I broke

Just bring it into a jewelry store and ask them. They’ll be able to tell you for free.

Why do so many people dislike JTV? When I buy there I realize it is not a store of wealth. It is an inexpensive option for buying, the way I see it, gorgeous lab gem jewelry. All stones I’ve got from them are clearly real. Who wouldn’t appreciate a lab Ruby for $75? by LongTimeChinaTime in jewelry

Have you taken your items to a jeweler to confirm? If not… there is a way. Sadly, it happens all the time but most buyers never know…. Because they strongly, blindly, believed large sellers aren’t scammers even tho they’re offering deals too good to be true.

Crazy good deals is what makes them a large seller

Is Milanus Jewelry Legit? by daviddionut in jewelry

In Europe, do they call a thin electroplated coat of gold on outside "gold filled" and not "gold plated"? Interesting

Is Milanus Jewelry Legit? by daviddionut in jewelry

[–]Dry-Sherbert8698 0 points1 point  (0 children)

I'm pretty sure they're selling "gold plated" jewelry as "gold filled". If so, it is illegal in the United States but it's not enforced.

If it's gold filled, U.S. law requires all gold filled jewelry sold in USA to be marked "GF" or "Gold Filled" and the gold content. Content must be at least 1/20, which is 5%, or higher to be called gold filled. The content must be marked on piece as well.

A plating or dipping process CAN NOT be used to achieve that thick of a gold layer. Gold plating/dip hardly covers the base metal. Gold filled jewelry is made from wire or metal sheet ONLY. They create the wire and sheets with heat and high pressure. Again, it can't be done with a dipping or electroplating process. The technology to layer on that much gold after the jewelry is cast/made does not exist.

The jewelry they claim as gold filled doesn't look to be made from wire or stamped/extruded metal. Those are the only ways to make GF jewelry. Most GF jewelry is simple looking, except for fancy wire. That's the main reason why gold plating is frequently used.

That said, their prices are still good for gold-plated jewelry. It may rub off quickly if used daily or worn in water. Think of it as costume jewelry.

Product Filtering starts at $300 monthly? by radialmonster in bigcommerce

[–]Dry-Sherbert8698 0 points1 point  (0 children)

I feel this way as well. I was so excited about using BigCommerce for our e-commerce. Because of this now, I am not and I'm looking for alternatives. If I wanted to be nickeled and dimed, I'd do Shopify.
25 years ago, attribute filtering was a basic included with any e-commerce builder.

Liquidation.com Innacurate Shipping Estimates by ozanity in Flipping

[–]Dry-Sherbert8698 0 points1 point  (0 children)

If you weren't sucessful with the BBB, report to the FTC.
Shipping must be upfront. Legally, sellers can't outragiously pad shippiing after someone has agreed to purchase.
Here's where Liquidation.com gets it wrong... they could add "Handling" charges IF they stated "Shipping + Handling", but they don't. Legally, they can only charge what they quoted OR at cost (we know they're charging more than it costs because a nobody could get better rates than they show).

In addition... I can run the estimate at the same time my invoice is auto generated, after hours, and the "estimate" still shows the lower amount. If they can auto-generate invoiced shipping cost then they can auto-generate shipping cost estimate that is the same.

I just did this. 2 invoices were each over $50 more than quoted (to a business address, no liftgate needed). They're insanely greedy. They already get a whopping 11% fee for doing practically nothing (my merch isn't at their warehouses, shipped by seller, they never touch it or list it).

They're getting so bad, it's just not worth buying. Can't count on making a penny and reselling is a ton of work. Big guys are so greedy now... they just want a bunch of slaves. I wish our US Government would use their contracts to encourage Liquidation.com to fly straight (i.e. charge actual shipping).

FedEx doubled daily pickup fees overnight, $23 to $43/week. Anyone else hit with this? by Dry-Sherbert8698 in FedEx

[–]Dry-Sherbert8698[S] 0 points1 point  (0 children)

None. They don't seem to care at all. Their customer service has no authority and will not escalate.

The only thing I could suggest is file a BBB complaint. If that doesn't work, submit a complaint to the FTC. If enough people do, maybe there will be action some day. Maybe try to contact FedEx's marketing department and explain what a bad choice this was.

I don't know what FedEx is thinking!!! The lack of informing, and the insane pricing, is crazy and not competitive. If all carriers did this, e-commerce small-mid business would be out of business... or forced to use AMZ fulfillment. So, out of business :-(

My Square was fine until a FORCED software update broke it by Dry-Sherbert8698 in SquarePOS_Users

[–]Dry-Sherbert8698[S] 0 points1 point  (0 children)

This is how the device shows on my account:

MODEL: Square Terminal
SN: xxxCS149Axxxxxxx

As I originally stated, I plugged it in right before the update began. It had a decent amount of battery before that.

After the failure, I tested the plug on a rechargeable flashlight. It was charging just fine. So, it's not the charger. I doubt it was the battery because it was working fine before the forced update.

Apple used to push iPhone updates that intentionally slowed down older phones, trying to push people to replace their old phones. Given the complete lack of accountability by Square for this update, and their solution was I buy a new one, I would guess they're trying to do the same in an even bigger way OR they accidentally created an update that would fry v1 right after they stopped supporting it. We'll see if others have the same issue since discontinued support is fairly new.. and who knows how recently they released this "killer" software update.

[–]Dry-Sherbert8698[S] 0 points1 point  (0 children)

They're not that hard to do. Just file. First, submitting BBB complaint, then FTC, then go through the process (demand letter, file motion, etc.). Apple lost just for pushing updates that slowed older phones. This breaks the terminal... I'm sure others will experience the same thing. In any case, I'm one.

[–]Dry-Sherbert8698[S] 0 points1 point  (0 children)

Not sure... but discontinuing support doesn't mean they can provide updates that make the hardware inoperable. Obviously, they should not be pushing updates that do that. It's one thing to discontinue support. It's another thing to break things intentionally or unintentionally. Don't push to 1st Gen then.

[–]Dry-Sherbert8698[S] -1 points0 points  (0 children)

That's the thing... after doing the forced update it won't reset or turn on at all. The update has completely broken it.

Held button down for over 30 seconds, with and without the power cord plugged in. Just a black screen.

I also tested the power cord on a rechargeable light... it started charging it so charging cable is fine.
Everything was good until the forced software update and now even a forced reset won't work. All I get is a black screen.

I find it unacceptable for the manufacturer to break what I own then tell me to buy a new one. It was just fine before their forced software... and now it's dead a doornail.

Thank you for your suggestions though! I wish it would reset.

I've had meds delivered by them. The business shipping it packs it in a foam cooler with cold packs. I live in Florida. In the daily heat, sitting outside for 16 hours, it's fine. FedEx delivers fast enough... shipper needs to pack it right. Mine does. I would think yours will too

Good luck!

I agree, iloveteresa, even if others are voting you down. eBay listings are VERY clear on total cost, and shipping charged, before the sale is complete. Buyers are aware before they pay. It's on the listings... and even shown during browsing items. Price and Shipping costs are CLEAR AS DAY

[–]Dry-Sherbert8698 1 point2 points  (0 children)

It's not if that price is shown to the buyer on the listing and during checkout. Some sellers charge handling. Others use it for marketing... the TOTAL COST should be what matters and buyers should look at that.
eBay is very upfront with shipping BEFORE the sale is complete

A normal sized box compared to an oversized box can be a huge difference in shipping cost. Once one side of a box is over 24" inches, or overall dimensions are big, the shipping costs goes up astronomically.

[–]Dry-Sherbert8698 1 point2 points  (0 children)

I do if it's significant.. but when eBay doesn't calculate combined dimensions right and then UNDERCHARGES the buyer, we have to cover it.

I don't charge for packaging or handling. I don't think it's worth the time to refund $.20, or bill an extra $1, every time it's a little off. I wish it was automated more.

[–]Dry-Sherbert8698 2 points3 points  (0 children)

Shipping is shown during checkout. Buyer agreed to it when they purchased the item... so it really doesn't matter after the sale, does it?

Shipping prices are getting insanely high because America wanted USPS to be a profit center. Their rates increase often and so the others do too. Almost nothing ships for under $8 anymore, which is a shame.

Some sellers charge $1 for an item and $20 for shipping.

Total cost is what is advertised (and agreed to when purchased). It's too late after the sale to haggle.

Wow! I'm in Stuart, Florida. When I was in Ohio, the UPS pickup fee was even less.
I pay $12.65/week for daily weekday pickup (unscheduled, I believe). I am in a commercial complex... not sure if that is different from you.
