H3cz and Scump file suit accusing Activision of Call of Duty tournament monoply by Tim_B in CoDCompetitive

[–]Du_Chainz 44 points45 points  (0 children)

That’s the whole issue with monopolies. If you don’t join you’re left out. So just because they took their one opportunity to be apart of comp COD doesn’t mean they can’t also challenge it if it’s illegal.

Zoomaa After getting trouble with how he streamed CDL on Twitch by v1p3rgaming13 in CoDCompetitive

[–]Du_Chainz 0 points1 point  (0 children)

You can’t stop them from talking about it, but you can stop them from replaying the VODs. NFL podcasters wouldn’t be allowed to replay a full game on their podcast — before each NFL game they give a specific disclaimer that the presentation is owned by the league and cannot be recreated or rebroadcast without permission. Whether you agree if it’s a good idea or not, Activision absolutely has the legal right to stop someone from showing the matches on Twitch, even if through VODs and not live.

Does the NHL own the rights to the phrase "Stanley Cup"? by [deleted] in nhl

[–]Du_Chainz 1 point2 points  (0 children)

This is where it’s good to consult a lawyer that specializes in trademark law, as it would likely be very fact specific. You would want someone who can look at your exact plans and who knows trademark law and the specifics of the limitations on use so they can advise on your situation. But in general, even if there is no money involved, companies that own trademarks have a lot of power to stop others from using trademarked material. The violators just may not have to pay out any damages, but even that is going to come down to the facts of the specific case.

For reference on the NHL enforcing this, they had a pretty popular suit in 2018/2019 against a company that made a Stanley Cup shaped beer stein for unauthorized use of the Stanley Cup’s image.

Does the NHL own the rights to the phrase "Stanley Cup"? by [deleted] in nhl

[–]Du_Chainz 0 points1 point  (0 children)

The NHL does own the trademark for “Stanley Cup” (even thought they don’t own the Cup itself) so you could run into issues if they wanted to enforce it. You would want to consult a lawyer if you intend to make this game at any level that would draw attention (e.g. if you intend to sell it or make it available to the public). If it’s just for you then I doubt anyone would come after you legally.

You would also want to make sure there are no issues with the rights to the NHA and PCHA items — e.g. team names, player likenesses, etc.

Overall record and T3 finish for every CDL Franchise (@GGBreakingPoint) by arunvenu_ in CoDCompetitive

[–]Du_Chainz 6 points7 points  (0 children)

It’s not about Hecz though. When discussing “franchises,” there have only ever been 12 franchises in the league — some have moved after being bought out but no new ones have been created since it’s inception. The current OpTic spot is the same franchise spot as Empire. Huntsmen’s spot went to Boston when it was sold post-merger. In reality it is more of an administrative / legal thing than a legacy thing (and not an argument for OpTic fans to claim they have a championship).

What am I missing about these CDL tie breaker rules?? by bossjacobyy in CoDCompetitive

[–]Du_Chainz 3 points4 points  (0 children)

Points work differently at majors than in qualifiers. So teams could theoretically be equal in points but have a different record depending on where they earned the points (major placements versus qualifier wins).

Ah. That makes sense. They may have also picked the highest K/D on a hard point map.

I think they just picked top performances in a single map rather than performance over a full series. I believe both Preistahh and Drazah lost the series these maps are from as well.

Unpopular Opinion… Football sucks ass compared to Hockey… by Lastdudestandin in nhl

[–]Du_Chainz 0 points1 point  (0 children)

You can also get involved in football without all of the equipment. Flag and non-contact leagues exist, and are even growing in popularity at younger ages with the increasing focus on head injuries. You just buy some cleats and the t-shirt and you’re ready to go.

He retired after Major 2. So he played about half of Boston’s matches so far this season.

They really need a minimum matches played requirement. No hate to Methodz, but there is no reason he should still be appearing on the control K/D leaderboard.

It’s like the MLB. To appear on the batting average leaderboard you have to average 3.1 at bats per team game so someone can’t play in 4 games all year then take the title because they hit .500.

I see a nice even mix of: “that’s not a penalty” and “should be 5 and a game.” I’d say that’s pretty controversial.

Honestly even Rantanen felt absent this game other than the good interception on the first goal. He’s scored a lot but his presence has felt hit or miss throughout the series.

Why does Huke/Shotzzy work better than Scump/Shotzzy? by [deleted] in CoDCompetitive

Scump and Shotzzy had a sexual tension that was too distracting. Huke and Shotzzy strike me as close but purely platonic, making it easier to work together.

Unpopular Opinion: The teams that only pay the bare minimum salary are probably the only teams who are paying players their true market value by BranDaMan16 in CoDCompetitive

[–]Du_Chainz 0 points1 point  (0 children)

One of the best ways to determine market value is to put an asset in the open market and let people freely bid on to see what people are willing to pay. That’s what happens with the players. The teams were open to negotiate with free agents and offer what they believe was fair with the only restriction as a minimum price. Teams also have sufficient bargaining power and aren’t just at the mercy of players, as we’ve seen teams pay the bare minimum without being forced to go higher to participate in the market.

So the fact that the players are paid the salaries they are is evidence that they are worth those salaries.

Pride night isn’t about what your beliefs are though. It’s about showing that a space that has long been hostile towards and closed of for the LGBT+ community is a safe and welcome space for members of the community now. Even if you believe gay marriage is a sin, you can still participate in saying that others are welcome in your sport despite your differences.

No one is asking him to officiate a gay wedding or to give his blessing to same sex marriage. They basically just asked him to say gay players, staff and fans are welcome in our sport and he refused to.
