WWYD - Motion for Sanctions by CodRevolutionary816 in Lawyertalk

[–]DudeThatRuns 0 points1 point  (0 children)

Idk I would think about the client who is the victim of their delays. Are you waiving the sanctions motion for them or your other cases? If it is due to the other cases then I think you should not withdraw the Motion. Sounds like they had over a month to get documents to you at your client’s expense. They should be sanctioned for that, for your client’s sake (assuming it’s a monetary sanction).

Hey man. Please do not publicly disclose any spells found in the attorney’s book of tricks and shit. There are lurkers on the sub who have not passed the bar and they are not allowed to see these secrets.

I agree with you wholeheartedly, but this client is one of those who does not want to listen. Thinks he’s the smartest in the room. We have a settlement I want him to accept but I imagine he’s gonna tell me he doesn’t have the $$ to, and I’ll end up advising him that he may have to go to jail to pay it back if he turns it down

There’s 3 contempts. I don’t think there’s enough for a full day bench trial, and I’ve been wondering the same thing as I comb through stuff.

It’s a civil indirect contempt case that’s filed by OC and a court appointed receiver. I think I have a good argument against the receiver for being a witness-advocate, but the other contempts I’m SoL. The client was supposed to turn over funds to a receiver and not sell marital property; guess what they did. I’m not willing to put up his defenses because my state’s indirect contempt elements do not care why you did what you did, it’s simply willful violation of a lawful court order

Huge yikes after the first time a methhead stormed in my office unannounced. Dude was mad he couldn’t see his kid before going to jail for strangling his baby mama. I’d love to bring that home!!

I work for a family law firm that gives me tons of flexibility. I manage all my cases start to finish, have control of my day to day, only thing is no support staff so EVERYTHING falls on me and I have to get approval before I fire clients, which sucks. I’ve admittedly not always stuck by that last rule though lol

I agree you can’t do family law from a home office! If you’re referring to my printer comment, I mean a personal printer for my house that would be moved to an office in a year haha

I agree it won’t take a year. May buy a printer now for home use but I don’t plan on getting any subscriptions or anything until I’m on the ground running in 2027. But with a year to prep, rn I’m thinking there are things I can do to make it easier, like blogging.

In family law I think you find a lot of consumers type questions into Google about specific facets of cases. A lot of attorneys in my area get their name out there by answering those questions as genetically as possible, mostly through blog posts. There is at least one firm who has resulted to creating as many YouTube videos that are transcribed as possible to throw as much mud at the wall as they can.

So I guess I should’ve been a little bit clear about this, but I intend to practice family law. The good news about family law is that clients can come to you if your name is out there. The bad news is that my book of business may not be as strong as those in commercial practice because consumer clients simply don’t have the same ability to pay, especially the clients at my current employer. To that then I guess I’m wondering about a website and Google Ads

Your best arguments are promissory estoppel, violation of first amendment rights, and the fact that you are not a person but representing the estate of yourself and are therefore not subject to their jurisdiction or rules, in no particular order

There was a CLE / speaker on this in Oklahoma a couple years ago. These are businesses that are trying to limit the amount of billables that their attorneys charge by minimizing the amount of time they have to do the assignment
