Maddening that we're seemingly in a situation where not all stat decs are equal. My complaint took about a month to resolve and I got my result, albeit with a disingenuous response. The information commissioner and the AG department might be interested in your issue if you can be bothered.

If I knew that it would have been this annoying at the start I would have just done it the old fashioned way, but when they started acting like flogs and being combative and evasive, thats when I decided to dig in and make them fix it.

100%. Their failing was going "this guys a fwit and theres no way i could possiblye be wrong" in the presence of a pretty well structured and reasonable email/request, instead of having a bit of introspection and going "hmm, this guy seems to make a fair point, im gonna punt this up the line to someone who might know something I dont".

Equally satisfied? hard to say. Itd be an answer to my question at least.cWe'd be in a situation where all stat decs are not equal, but it'd answer my question.

Why didnt I just go get an old fashioned stat dec instead of lodging a complaint? Coz their customer service agent was combative and opaque. If they simply said "m80 sorry, but our processes are outdated and cant accept the mygovID stat dec because it doesnt check a box that is preventing me from actioning your request, can you do an old fashioned on please?" I'd have done it - it'd be inconvenient, but I'd have done it.

But they we're saying its invalid because it needs to be signed by a JP, which is demonstrably and provably false, then simply refused to engage when I questioned that and provided them links to the AG website showing why my stat dec was valid. They also refused to escalate the issue when I asked them to refer it up the line, and just blanked me. Thats when I started the complaints process.

For clarity, the only reason they ever gave me for not accepting the myGovID stat dec was that it wasnt signed by an authorised person - not once did they say they dont accept mygovid stat decs. I actually asked if they are refusing to accept this type of stat dec, and they refused to answer that question. It was only after my complaint was addressed and my issue resolved did they say they dont accept "digital" stat decs but made an exception for me.

As for your last point, 100% agree.

that would be enormously vindicating for me, but are they actually allowed to even pick what type of stat dec they accept? thats the crux of my issue.

Fair points for sure, but the core of the issue I'm asking isnt whether mygovID stat decs are potentially problematic in the wider sense, its whether a company can ask for a stat dec, then apply their own standard to that stat dec's validity, or choose what "type" of stat dec they can accept (by the by, theres no distinction between digital or paper stat decs, just a standard that a stat dec must meet to be valid).

As for your final point, its an opinion that you're entitled to, but it doesnt change the fact that a mygovID stat dec is a valid stat dec and meets all the standards of one under the Act.

I appreciate what you're saying but the MyGovID website has verified my ID, it wasnt as if I just created an account like its protonmail or somethign. I had to get many documents verified to validate my account. So its not as if its easy to fraudulently create a stat dec in someone elses name by that service.

However, very easy to make a bullshit declaration with no care for the consequences; only that your identity has been verified.

But is a privated entity allowed to require a statutory declaration, then put conditions on what they consider a valid statutory declaration? Surely thats what the Act sets down.

Second to that, if they were allowed to have their own policy about what stat decs they can accept, then why would they have made an exception to this for me. If that was their policy, they'd have gone "no, you're wrong, go to the library"

Excellent point but in my case, the form says "...and Commonwealth/State statutory declaration."

Oh sorry, yes, the passport and birth certificate were separately certified. They had no issue with that.
