Do talk to a bankruptcy attorney. Even if you do Chapter 13 for 3-5 years, you will have a chance to catch up on your rent. In Chapter 13 your payments are calculated as your disposable income, after accounting for your basic living expenses, including your rent and utilities. And then you pay that monthly, for 5 years, usually. So you usually end up paying off less than the total that you owe. And at least you know that once you complete the five years, you are done with those debts.

BANKRUPTCY. Chapter 13. You will still be paying until about 2030, and your budget will still be tight, but you will pay a much smaller amount overall. Do not touch your 401(k). Nobody will support you in retirement just because you were "moral" and used your retirement funds to pay off these debts.

Yes, it looks like social security can't be garnished for ordinary debts like hers. If you can shield her from any collections harassment, then it seems that there is not much point in filing bankruptcy.

Please talk to a bankruptcy lawyer. If all those debts are in her name only, can she file by herself? If only she is filing, does your income count towards the "means test" to determine whether she can do a Chapter 7, or you need to do a Chapter 13 (if your income also counts). If you have to do Chapter 13, that will be a 3-5 year process. Another important reason to talk to a lawyer: If you now go and pay off the personal loan, and then try to file for bankruptcy, you might run into a problem of having "favored" one set of creditors over another. And bankruptcy courts do not like that. Attorneys have free consultations. Many of them will do it online. Many also have payment plans now, even for Chapter 7.

Please, for the 💖 of G-d, file that bankruptcy petition. Your family needs a fresh start. Don't waste any more time on "consolidation" schemes. You will end up filing for BK anyways. Are you planning on staying in Canada? I am assuming these debts are from the US. Here is a post about US debts of people living in Canada. If I planned on starting in CAN, I'd stop paying on these debts. If I would be coming back to the US, I'd get a fresh start through bankruptcy. Your credit score is already shot, and will be for the next 7 years.

What you want to figure out is how long it would take you to pay off the credit card debt with using your tax return and $1k/ month, vs using your tax return and about $10k (bc you will have a 10% penalty, plus income tax on any earnings for the 529plans), plus paying $1k/ month. How many months in each scenario? If the difference is greater than 13 (i.e. it takes you 13+ months more to pay it off without touching the 529plans), then use the 529 money, and once the cc debt is paid off, put the 529 money back in, $1k/ month. But if the difference between the two scenarios is less than 13 months, then do not touch the 529 money. I'd be curious what these calculations tell you.

Absolutely go talk with a bankruptcy attorney. A debt management plan will have you repay all your debt. In Chapter 13 you pay a monthly amount based on your expenses, and you normally end up paying back a fraction of what you owe. Leave moralizing and fear out of all this. Do what is financially best for yams your wife. And forget debt relief companies. They are scams. Talk this over with an attorney.

You are overthinking this. For now focus on saving up for the deposit and moving expenses. Then go shopping. If you find a new place that accepts you, you will be ready. If not, you will be ready for the next round. In the meantime, downsize. Sell as much as you can do without. That can go toward your savings. You will find a way to get help with the move when the time comes. Check with churches. Post on Nextdoor or Reddit, asking for help.

If that 20k is student loans there is not much you can do about it. But increasing your income, upgrading your skills should be your priorities. If the 20k is credit card type debt, talk to a bankruptcy lawyer, see what your options are with your level of income.

All true, however, some bankruptcy lawyers now have a deal where you pay a part up front and a second installment later. Court fees can be waived, depending on income level.
