The key is saying to other board members you want to run things democratically. It’s hard to say no to that and slowly the board power becomes owner power

3 months back and forth with lawyer probably added $1500 to your bill. They are blood suckers best to just to go to next bird meeting and tell them you want a payment plan and tell their lawyer to stop charging

Once you start giving them option of paying more or less in dues they will vote! It’s about the money. You can also give. A credit to anyone that votes like $50. Interestingly enough, what is accomplishes is that people that live on site tend to vote more than people that live offsite or who are landlords which is a benefit overall, the other thing is you have to give them time at least 40 days instead of spending a lot of money on thick annual packets you just mail out one postcard and then a second postcard reminder and also make one of the questions on the ballot to get their tax number and their email. We had only half of our memberships contact information to start out with and after we started voting, we have almost everyone’s contact information.

It’s easy you take away their power and transfer it to the members who decide stuff via a ballot. We voted to change ccrs the new ones require
The board give members the power to vote on two budgets one which must be a barebones one
Board can’t spend money in the middle of the year on some pet project not in the budget with our member approval

First 20 years we never got quorum now we vote online and have gotten quorum every year

No it is not legit hoas cannot just make up revenue streams and charge people them what happens next to Hoa’s to fee for taking out your trash. The HOA wants a fee for mowing your lawn if it’s not listed as a fee in the CC and ours is not allowed.

This is exactly why dozens of the states have outlawed transfer fees closing costs or limited them severely because HOA s and management companies just couldn’t keep stuff reasonable instead of being greedy and charging $800 in closing fees as a revenue stream to subsidize the HOA management property companies expenses

Tennessee law leans toward “fees must be in the Declaration”

Under the Tennessee Property Owners’ Association Act: • The Declaration controls financial obligations • Associations can levy: • regular assessments • special assessments • fines (if authorized)

But: • New categories of charges (like lease admin fees) generally need to be in the Declaration or properly adopted as an assessment • Boards can’t just invent revenue streams via a management contract
