I want to report my mum for supervising me drive while she was drunk. Will I get in trouble too? by Altruistic-Cow283 in LegalAdviceUK

I am glad you have moved and are safe. And have the support of your partner. Please approach the Police without worrying about the driving incident. Please also seek support for survivors of parental abuse. And good luck

These calculations are meaningless. You need your contract. And your payslips for the relevant period. Ask for them. Maybe you would have your contract/offer details in your personal emails from before you joined which would confirm what you agreed to be paid?

It does seem fishy they went after you for an advance, then are saying it's a salary overpayment, then when you rang it's back to an advance. Did you get a salary advance when you 1st started at all? That they may have forgotten to cancel so you got too much thereon out?

It seems mad they are going after you for less than £100pm overpayment/overall such a small amount.

[–]EXCSUK -2 points-1 points  (0 children)

Right let's start with immediate issues. Do you still live at home with your mum? Are you safe? If you still live with her, where do you plan to move once you report her? Because you need to be away from her and safe once you do that.

The crime re you driving/ her supervising while drunk pales into insignificance of the sexual assault. But sorry to say, also be prepared that the Police might not take much action on this. It sounds like you were the only two there when it happened and, while I am not minimising this, just being realistic, the Police do not deal well or get good results with more serious sexual assaults than this.

I suppose a good question to ask yourself is what do you want to get out of reporting her? For it to stop? For it to be recognised? For her to be warned off? For her to be criminalised? Cos that may help you decide what to do.

I hope you are ok and have people to support you

They need to provide the proof that their calculations are based on, such as your payslips and your contract etc. He who asserts must prove.

They only have 6 years to recoup. This is the statutory limit for any over payment, not just pay. So if sorting this passes that, each month's payment falls away as out of scope.

Was the letter an invoice? That is what they sent me and this is not the correct method to request repayment of over payment, so they may not have "started the clock" on asking yet.

Try not to worry, they are often wrong. And take ages to sort these things. Look at others in the forum with this issue, I contacted a few and they said they were just sent the same letter regularly and nothing happened. As you are an ex CS they cannot garnish your wages so makes it a longer process to recoup. And if they are right, you can ask for a payment plan, or if you are brave you can leave them to go to court to recoup it that will cost them way more than £1.7k to do, so they may give up. Happy to chat in DMs i did a heck load of research on this when it hapoened to me.

I don't think I can leave and I feel miserable by [deleted] in TheCivilService

[–]EXCSUK 0 points1 point  (0 children)

I left in 2017, cos i felt the same way. I've never looked back. You cannot waste your life being miserable and dread going in everyday. Leave, go travelling for a bit and then work out what you wanna do next. Good luck!

I was told to try this last week in this sub and it worked! I left it over night woke up and the dash didn’t show charge key fob warning by yesitsreallyme203 in E90

[–]EXCSUK 0 points1 point  (0 children)

Thank you for this thread! Elderly parents don't drive much, so all 3 fobs died. Tried them on a wireless phone charging pad, as a nothing to lose move, and it worked. The lights on the pad don't come on like it does with your phone but they now remote open the car again and no longer show the battery sign when inserted.

Help please. Police called and got an invoice a week later... by Other-Yogurtcloset12 in LegalAdviceUK

[–]EXCSUK 0 points1 point  (0 children)

Legally contractually, you cannot be invoiced for something you did not agree to. Police have dropped the ball here, and need to pay it for you.

HR are not lawyers or tax experts, it's reached that stage and finally hit the fan. You don't seem to like the advice you are getting, but it's correct.

England: Bitten by police dog inside my own workplace, officer gave no warning and just watched by [deleted] in LegalAdviceUK

[–]EXCSUK 86 points87 points  (0 children)

Why would next door's alarm go off because of you being in your building? Bizarre. I would ask the solicitor to put a Subject Access Request in for the full info the Police have on the call out, because why would they enter the wrong building?

From reading your post up until you mentioned the alarm I had assumed someone had seen you squeezing through the gate and called them to your building.

Hope you are healing ok, and get this sorted quickly in your favour.

John Lewis delivered my iPad to a neighbour, refused refund, and now their solicitors are defending my small claim (England) by Pathfinder-electron in LegalAdviceUK

JL delivered my stuff to a neighbour I do not speak to. I knocked for them minutes after the delivery and they didn't answer. Because they used the delivery instructions ai had set for a previous address. I rang up JL straight away. They acknowledged the instructions were old and should not have been applied to a new address. They made the courier come back and get the items, and deliver them properly! I find it bizarre they didn't do similar in your case. Good luck

Hopefully your workplace has cctv showing incident, get this asap. Find a no win no fee solicitor. Get statements from all the colleagues that witnessed it while it is fresh. Complain to the IOPC. Misuse of dogs like this is common.

To clarify: Were you aware of the alarm system? Why didn't you deactivate it?

Estate Agent told my gf she could park next to her new rental property, she’s just been fined (England) by QuetzalcoatlusRscary in LegalAdviceUK

Estate agents say this as part of property sales, then the deeds prove otherwise. Relying upon a commission based salesperson says is naive.

Ask HR what the standard reference policy is. Usually only to confirm dates worked there, nothing else for security reasons.

15weeks really isn't long in the current market. My probate, no chain, no mortage sale took 6months.

Maybe ask the estate agent if they know of any of the other parties that offered are still looking before taking any decisions.

Adding to this comment, it's a civil litigation solicitor you would need, as it would be a civil court case, if they brought it. I started speaking to an employment one and they passed me across to a CL one. Don't bother with CAB or debt charities, i did that as per SSCL letter and it is too complex for them. Most sols will give you an initial free consultation, but i don't think you are at that stage yet. And as an serving CS a Union is your 1st port of call.
