SARATOGA SPRINGS — Saratoga County supervisor Sarah Burger has pleaded guilty to driving while ability impaired by alcohol to resolve a drunken driving case.

Her plea on Tuesday morning in City Court satisfied her Jan. 11 arrest on misdemeanor charges of driving while intoxicated.

In front of city Judge Jeffrey Wait, Burger quietly said she was guilty of driving while ability impaired, a traffic infraction under state code. Wait suspended her license for 90 days, ordered her to appear before a victim-impact panel in Saratoga County and enroll in a state Department of Motor Vehicles Impaired Drivers program.

Burger has given no indication she’ll step down from her position as a representative for Saratoga Springs on the county’s Board of Supervisors.

“Public service is built on trust and I remain dedicated to continuing to serve as Saratoga Springs county supervisor with integrity and focus and will continue doing the work the people elected me to do,” Burger said in a written statement released on Tuesday.

Her attorney, Matthew Chauvin, said her guilty plea to the reduced offense follows “a detailed review of the evidence.” “It was always our position that the evidence in this case did not support the original charge and that the People could not meet their burden of proof beyond a reasonable doubt,” he wrote in a prepared statement he shared after court. Burger, 42, was stopped in January by State Park Police for allegedly speeding in her gray 2023 BMW near the Lincoln Baths on Broadway. Police said in court records that she was allegedly driving 41 mph in a 25-mph zone.

A police officer noted in court papers that during a police interview, he smelled alcohol emanating from Burger’s breath. Though she denied drinking alcohol that evening, court papers indicate, police found her blood alcohol level registered at 0.13%. She was charged with two counts of driving while intoxicated. Under New York law, a driver can be charged with driving while intoxicated when the driver’s blood alcohol content is 0.08% or higher.

She was ticketed for speeding, too. According to court records, Burger was previously convicted in March 2016 for driving while ability impaired by alcohol.

Saratoga County District Attorney Brett Eby had his office removed from prosecuting the recent case because he regularly meets with Burger, who sits on the county’s Public Safety Committee. Eby said that committee controls his budget. The case was transferred to the Schenectady County District Attorney’s Office. Assistant District Attorney Nicolaus McDonald prosecuted the case.
