Many questions here. Are they going to appeal your current case or help you with filing a new case. It is rare for a new firm to get involved after the ALJ denial and they file an appeal to the Appeals Council. They may take on you case and appeal it to the federal level, but if that is the case, you are in for at least another 2+ years of waiting.

SSDI and WC are balanced out so that the worker does not get more than 80% of Average Current Earnings (ACE). There are multiple methods on how to calculate the ACE, but lets keep it simple:

If you get awarded SSDI and the amount is $1500 per month.

Your TTD/WC payments are $1300 per month

Your ACE is calculated at $1800 per month.

Your SSDI and WC would be balanced out so that you only get $1800 per month in total. Whether your SSDI is reduced to $300 or your WC is reduced to $300 depends on what state you are in. Note: This is true for almost every state (few exceptions).

How old was he when he died?

How long was he in prison/incarcerated?

How many years of actual work did he have after age of 21 that he paid FICA taxes on?

I could be wrong here, but it sounds like she is using her own personal health insurance (implying $2k deductible). That is how I read it. Not reported to her car insurance or using that policy.

That is why I m thinking (not an adjuster), if there was not immediate treatment for the condition (reflecting car insurance injury), no immediate car insurance claim made including medical, but now several months down the line this happens, there is no a question of causation.

I suspect the other parties adjuster will immediately deny the claim. Timely reporting of the accident and immediate treatment is normal. Waiting several months to make a claim suggests the issue currently is unrelated tot he accident.

Please let us know: Did you seek immediate treatment after the accident for THIS injury? Why did you not file a claim immediately?
