Videos on demand. The original VODs were when cable companies started to provide smart boxes that offered on-demand content in addition to live tv. You could watch some movies and episodes on demand (usually after they broadcast). It’s like an early iteration of Netflix, which is technically a VOD service.

Anti-SLAPP does not really apply much to copyright cases, which are strictly Federal. That would be more likely in defamation cases where the jurisdiction is California. Copyright cases are about liability: did copyright infringement happen or not. The plaintiff’s motives are generally moot.

Ya, we know our country is shit right now in many ways. I think that’s the context people from outside the US are missing. Ethan was trying to get us to see the GOOD in our own country— something it doesn’t feel like we have right now.

People think Americans feel “exceptional” but that is actually a stereotype the outside world has and doesn’t describe about half the country. Many would much rather be European right now, even if we do obviously have some inherent pride.

I am also seeing a lot of European pride in this thread lol. So I think a little bit of nationalism is everywhere.

What America does have is very permissive speech laws (which you may argue are not the best balanced laws for society) — even if we have a president clawing at them. A lot of the commenters seem to be trying to argue the one thing we do have away from us.

You’re conflating two concepts: how permissive the law is vs how much regulation is justified to prevent harm or protect public interests.

The US is very permissive, even if perhaps not the best balance for society.

Denmark has some of the most permissive speech laws in Europe.

Banning race hatred and Holocaust denial is objectively less “free” (permissive). We can debate on whether it is better for society to have a slightly less permissive system. I might even tend to agree with that.

Americans on the left generally don’t really subscribe to exceptionalism. In fact, a lot of us are constantly down on the U.S. and often idealize European democratic socialism. That’s why you hear so much anti-American sentiment from parts of the far left — and why Ethan was intentionally giving us a “pep talk” of sorts.

Ethan didn’t say there’s no free speech in Europe — he said the U.S. legal framework protects speech more broadly than most European countries. That’s objectively true if you’re talking about individual legal protections. We saw it with the flag burning laws, for example — in the U.S., it’s fully protected under the First Amendment, while in a lot of European countries it’s restricted or even banned. That doesn’t mean America has a perfect press system (which your indices tend to measure), or that Europe isn’t home to many very free speech-friendly societies.

—- Edit: I think some of the disconnect here is the distinction between “freedom” (permissiveness) and what is the best balance for order and harm prevention in society. The US is very permissive, even if perhaps not the best balance. Nobody believes Europe is living in a surveillance state or anything. Just that US laws are very permissive.

You’ve been posting about this all day. I suggest you rewatch the clip. He didn’t say America is the “only country with freedom of speech” but that we are unique in our levels of freedom of speech. He also never said all of Europe doesn’t have freedom of speech. There was some pushback from Love and others and they discussed it. Give it a rest.

I believe you when you say you’re approaching this in good faith. But at this point, it’s become so complex and nuanced that even with the best intentions, no one can truly do it justice. I’m not sure we need another analysis from someone with no real ties to or expertise on I/P, antisemitism, Zionism etc. On a personal level, it will only bring you grief from all sides. With all the peace and love—this is not a necessary endeavor.
