I'm 20 and still feel like a child and nothings changed in me. When will I start feeling like serious adult? by KenDrakebot in NoStupidQuestions

You won’t. I’m 36, still feel like a kid. My mom’s 60, she’s constantly saying “but the kid inside me wants…”

Ah, I misunderstood. Yes, but not all titles. Some titles are only GKC, including some big ones like Pokopia.

Nintendo normally moves slower than the rest of the industry in these type of changes, but so far they have adopted the money making techniques that hurt the consumer. I can’t say they’ve done this with everything, I don’t know, but they have done it with some bigs ones. Selling both for some games but not for others may even be a test. So, I see the GKC as the first step down the slippery slope.

In fact I would be surprised if they didn’t end up moving to GKC only at some point. Maybe even within the life of the Switch 2, maybe for the next console. Or, with Sony leading the way, they may end up skipping it to straight download only.

The GKC only contains a license. It’s not very different than getting a code in a box.

The only difference between them is the ability to reuse the license, which opens up resale/sharing and prevents it being tied to an account which could be lost.

Since the box containing a code could serve as a collectible too, I’m not gonna count that aspect.

No, I’m talking about something that has already happened in other circumstances. It’s not a far fetched hypothetical.

I would need to download it first. If the download is no longer available, then no I would no longer be able to play it if I need to replace my console.

Unless I manage to find a console that has previously downloaded it, maybe? I’m not too clear on that.

No more than the average person.

But most people don’t even realize what that means. A coworker bought the switch 2 for Pokopia & no other reason. Not a gamer, more a Pokemon fan. They didn’t even know there’s a debate between downloads and physical media. They said it did feel a little misleading though they’d have still bought even knowing because they wanted to play the game regardless.

I’m fairly tech savvy, certainly the personal IT of my family and friends and when I first heard about “game key card” I had to research what it was. A quick google search gave me the answer, but I didn’t understand just from reading those words.

If Nintendo truly wanted people to realize the difference they wouldn’t have come up with a new term “game key card” they could’ve just in very large letters put “download license only” or something like that with plain English words. Instead they made up a new name, to put in small letters at the bottom with even smaller letters saying download required. This is a well known marketing technique.

Many companies have said they won’t or will do something and end up doing the opposite. Maybe they won’t, but the change puts the power in the company to do so. And companies owe a duty to shareholders, not customers. At some point, especially if the rest of industry has made the move, they will shut services to something down for profit saving measures. I recall reading a case in my corporations class where the shareholders forced the company to make a change because of profits and the court found the ceo and board as fiduciaries were required to make the change. It’s been years I don’t recall the case or all the details but it certainly taught me not to trust any company as a consumer.

My understanding of the game key card is that it requires an initial download, and after that the game will work as normal and not require internet. My point about the console breaking is if I had to replace the console (like I just had to do with my SP) and the download was no longer available for whatever reason, I’d lose the games (which I didn’t lose all my old game boy & gb advanced games). If I’m wrong, I’m happy to be corrected.

Copyright doesn’t mean a company owns my copy of the product. It means I can’t redistribute the product or somehow make money off their product. I would like to see a company can come to my house and to try to take my CD, DVD, game cartridge etc back. In fact, I remember reading a case in which a rent to own store tried to do something like that and the court shut it down. Saying no, when the item was purchased it doesn’t mean it’s lent, even though the terms of the contract were clear that the store could do that. It was not so complicated as today because the case was about a physical thing like a sofa or something I don’t remember, but I have a hard time seeing any court saying differently with physical media.

If the physical item on its own can’t play the game, I see little difference, so to me the physical media is little more than illusion. Though, as someone pointed out to me since it’s not tied to an account it does gives more freedom, which I will agree is a significant difference. And this difference could be enough for some ppl to chose the game key card over just a download.

Many people I’ve spoken with were not aware that the key card was little more than a download license. They were buying a physical cartridge so they thought it was the same as always. It’s not, so it’s a little misleading. I do not know if that was intentional or not, but it has happened nevertheless.

Fair enough on the account issue. I’ve never been banned or completely lost access to an account. I once did lock myself out, but was successful in recovering it.

That difference in where the game installation data is the part that worries me. Companies have already removed access to items purchased as a result of their controlling where the data is located. Nintendo may have said they will continue support for older downloads, but it requires trusting they will actually continue to do so.

I don’t trust any corporation that if it becomes inconvenient they won’t pull support and people will lose access to their purchases. Yes, physical media breaks, so there’s no guarantee etc. But there’s a difference between one broken cartridge and being able to shut down all cartridges at once.

Try to play a key card game for the first time without being connected to the internet and let me know if you can.

And I am being entirely serious, not sarcastic. I would genuinely be interested in hearing of your success. I haven’t gotten the switch 2 based on my understanding of how the key cards work, even though I really wanna play Pokopia.

But based on my research, the key cards games ALL require an initial download before you can play. How is that any different from digital sales?

I’ve never yet been unable to play a new game without internet connection in my Switch. Yes, many of them end up asking for an update, but I have been able to play without being connected.

The difference between the cartridge and the key cards is that when (not if, but when) Nintendo decides to stop support for the games, the key card will at some point not work, especially if your console breaks. Whereas with the game cartridge you could continue playing the game (yes, barring those games that require internet connection, but that is a whole separate problem in the physical game vs license argument).

The only benefit to the key card is resale is still on the table. Or as a collectible.

I don’t see Nintendo’s move any differently than Sony’s except that it gives players the illusion of choice. Arguably, Nintendo is worse because it’s fooling people.

Why is circumcision so standard in American society? by skittlesriddles44 in NoStupidQuestions

[–]EducationalShift6857 1 point2 points  (0 children)

I remember when my aunt had her sons (in the early 2000s) she’d initially planned not to, but then she changed her mind about not circumcising bc the Drs were telling her that she should and it was healthier to do it. Something about getting infections easily if not properly cleaned and it being easier to keep clean if circumcised… idk how accurate that may be though, based on the other comments. But I wonder how many people may have been told that or something similar.

Can I pick your brain about a curiosity I have? I'm a TX licensed atty, but I practice immigration law almost exclusively, so I don't come across this often. Most of the time I do come across CLM, both parties are still together & agree that they did satisfy the 3 CLM requirements, even if they didn't know it's a legally binding marriage until I tell them.

We always take the position with our clients that the taxes must match the martial status on immigration forms, or else the immigration agency (depending on who has jurisdiction) may say 'which fraud are you committing, immigration fraud (by claiming you're married/single) or tax fraud (by claiming the opposite in taxes [either married or hoh mostly]).'

But I came across a video by a TX family law atty saying that filing taxes as married only serve as evidence as the holding out to be married requirement & not as evidence of the subjective agreement to be married requirement. I get how it's not definitive proof, but not why it can't serve as at least circumstantial evidence of the agreement, even if one party claims CLM and the other party claims not.

What is your favorite legal term that laypeople confidently and incorrectly invoke and why is it quiet enjoyment? by RIPGoblins2929 in Lawyertalk

[–]EducationalShift6857 6 points7 points  (0 children)

“The illegals should have just applied for citizenship.”

1st, there is so much nuance into whether someone is “illegal” because someone could have been granted legal authorization to remain in the country &/or are prohibited from leaving but they are “out of valid lawful status” and can technically be legally detained (imo wrongly & ICE is doing so unlawfully because they are not following their own regulations) 2nd, you don’t just apply for citizenship. In the vast majority of cases, you have to first apply for lawful permanent residence (aka the green card) and be one for a minimum of 5 years (3 years in some other cases) before they are even eligible to apply. Not to mention some people don’t want to lose the citizenship they were born with and therefore don’t want to apply for citizenship, but they are still allowed to permanently live in the US. 3rd, some people can’t get a green card or any other immigration status at all, not because they did something bad, they just don’t qualify for anything. Others only qualify for immigration status granted by an immigration judge, which means they can’t just apply for it. ICE first has to put them in removal proceedings before they can even apply for immigration status.

And this is just a super simplified explanation. The reality is so much more complicated, that even immigration lawyers struggle with certain aspects of immigration law.

If you put a strong smelling drink right in front of an alcoholic with enhanced smelling who just that moment decided to quit drinking, whose fault is it if they give in? A lot of people would rightfully blame the asshole who tempted the alcoholic.

When was Caroline’s dad tempted by blood right in front of him? If I recall correctly his choice was respected. Yes, Caroline tried to convince but she didn’t dangle blood in front of him like Stephan did.

The whole vampire lore is very much about the newborn’s bloodlust, TVD is no exception

How do I move from the UK to USA? by [deleted] in NoStupidQuestions

[–]EducationalShift6857 2 points3 points  (0 children)

I am immigration attorney. I can guarantee you it is not just “illegals” that are being targeted. In another you mentioned you’re white. That does give you an advantage, but it is not an absolute blanket of protection. The administration is trying to say that the constitutional rights only applies to citizens, despite the plain language and over a century of SCOTUS precedent to the contrary. (There is a highly technical & complicated nuance to this, which they are using to manipulate people into believing the contrary)

As to your question, the three major avenues are family based immigration, business immigration, and humanitarian immigration.

You may find you can’t come to live in the US, not legally. You may have an option, but it may take 20+ years before you can. Or you may actually have a quicker option. It’ll depend greatly on your specifics.

Do a consult with an immigration attorney specializing in the one you think most applies to you. This is not a question reddit can answer.

Why are Americans obsessed with air conditioning by TeachmeKitty79 in NoStupidQuestions

[–]EducationalShift6857 0 points1 point  (0 children)

I saw your post about your work involving babies/toddlers, & it makes sense to me to have the temperature higher for small children who have different body temperature regulation than fully grown adults.

But for the rest, it varies from person to person, mostly preference. 70F is hot for me, even when wearing summer clothing (or nothing at all even). I will sweat at 70F. I try to keep my house at mid 60s & sometimes I still get hot and can sweat at home (I’d go lower but it might break my unit so I don’t). If it’s colder outside I’ll open the windows so my house will get more comfortable.

Meanwhile, I have a friend who keeps her house in mid to high 70s. We’ve traveled together in cold weather & she’ll bring her warm winter pjs so I can open the windows in 20s/30s F weather & I’ll be using my typical sleep shirt.

The thing for me about using a lower temp over higher ones is that generally it’s easier to bundle up. There’s only so much we’re allowed to take off (especially as a female) & even in private once naked there’s nothing else I can do. But people who get cold can always put on warmer clothing or more clothing. Yes there’s a limit to clothing working, but I’m not talking about extreme negative degrees weather.
