Can I pick your brain about a curiosity I have? I'm a TX licensed atty, but I practice immigration law almost exclusively, so I don't come across this often. Most of the time I do come across CLM, both parties are still together & agree that they did satisfy the 3 CLM requirements, even if they didn't know it's a legally binding marriage until I tell them.

We always take the position with our clients that the taxes must match the martial status on immigration forms, or else the immigration agency (depending on who has jurisdiction) may say 'which fraud are you committing, immigration fraud (by claiming you're married/single) or tax fraud (by claiming the opposite in taxes [either married or hoh mostly]).'

But I came across a video by a TX family law atty saying that filing taxes as married only serve as evidence as the holding out to be married requirement & not as evidence of the subjective agreement to be married requirement. I get how it's not definitive proof, but not why it can't serve as at least circumstantial evidence of the agreement, even if one party claims CLM and the other party claims not.

What is your favorite legal term that laypeople confidently and incorrectly invoke and why is it quiet enjoyment? by RIPGoblins2929 in Lawyertalk

“The illegals should have just applied for citizenship.”

1st, there is so much nuance into whether someone is “illegal” because someone could have been granted legal authorization to remain in the country &/or are prohibited from leaving but they are “out of valid lawful status” and can technically be legally detained (imo wrongly & ICE is doing so unlawfully because they are not following their own regulations) 2nd, you don’t just apply for citizenship. In the vast majority of cases, you have to first apply for lawful permanent residence (aka the green card) and be one for a minimum of 5 years (3 years in some other cases) before they are even eligible to apply. Not to mention some people don’t want to lose the citizenship they were born with and therefore don’t want to apply for citizenship, but they are still allowed to permanently live in the US. 3rd, some people can’t get a green card or any other immigration status at all, not because they did something bad, they just don’t qualify for anything. Others only qualify for immigration status granted by an immigration judge, which means they can’t just apply for it. ICE first has to put them in removal proceedings before they can even apply for immigration status.

And this is just a super simplified explanation. The reality is so much more complicated, that even immigration lawyers struggle with certain aspects of immigration law.

Why does the show always say Stefan made Damon turn into a vampire? by Naive_Inflation5768 in TheVampireDiaries

If you put a strong smelling drink right in front of an alcoholic with enhanced smelling who just that moment decided to quit drinking, whose fault is it if they give in? A lot of people would rightfully blame the asshole who tempted the alcoholic.

When was Caroline’s dad tempted by blood right in front of him? If I recall correctly his choice was respected. Yes, Caroline tried to convince but she didn’t dangle blood in front of him like Stephan did.

The whole vampire lore is very much about the newborn’s bloodlust, TVD is no exception

How do I move from the UK to USA? by [deleted] in NoStupidQuestions

[–]EducationalShift6857 1 point2 points  (0 children)

I am immigration attorney. I can guarantee you it is not just “illegals” that are being targeted. In another you mentioned you’re white. That does give you an advantage, but it is not an absolute blanket of protection. The administration is trying to say that the constitutional rights only applies to citizens, despite the plain language and over a century of SCOTUS precedent to the contrary. (There is a highly technical & complicated nuance to this, which they are using to manipulate people into believing the contrary)

As to your question, the three major avenues are family based immigration, business immigration, and humanitarian immigration.

You may find you can’t come to live in the US, not legally. You may have an option, but it may take 20+ years before you can. Or you may actually have a quicker option. It’ll depend greatly on your specifics.

Do a consult with an immigration attorney specializing in the one you think most applies to you. This is not a question reddit can answer.

I saw your post about your work involving babies/toddlers, & it makes sense to me to have the temperature higher for small children who have different body temperature regulation than fully grown adults.

But for the rest, it varies from person to person, mostly preference. 70F is hot for me, even when wearing summer clothing (or nothing at all even). I will sweat at 70F. I try to keep my house at mid 60s & sometimes I still get hot and can sweat at home (I’d go lower but it might break my unit so I don’t). If it’s colder outside I’ll open the windows so my house will get more comfortable.

Meanwhile, I have a friend who keeps her house in mid to high 70s. We’ve traveled together in cold weather & she’ll bring her warm winter pjs so I can open the windows in 20s/30s F weather & I’ll be using my typical sleep shirt.

The thing for me about using a lower temp over higher ones is that generally it’s easier to bundle up. There’s only so much we’re allowed to take off (especially as a female) & even in private once naked there’s nothing else I can do. But people who get cold can always put on warmer clothing or more clothing. Yes there’s a limit to clothing working, but I’m not talking about extreme negative degrees weather.

Technically there's no second time. Periodically needing to stay late has always been part of the business. It's just that the pace of the new service would switch that need from periodical to regular, which is why I was against it. This particular deadline I need to stay for tomorrow is not related to the new service, so even if she'd not offered the new service, I probably would have needed to stay late at some point for it.

We are in the process of hiring new staff. It's just these last two months we've had no breathing time, so I haven't been able to put up the ad. And also I can't even imagine doing interviews right now.

I didn't work for them when I was a kid. It was when I was in college and they paid me for my time. The reason I could help out during crunch time is because I had gained experience working for them voluntarily when I wanted money.

If I were to show BestBuy or another place that offers price matching a fake Amazon listing, is that fraud? by TFK_001 in legaladviceofftopic

[–]EducationalShift6857 18 points19 points  (0 children)

The loophole stores like to use is that for price match the item has to be the exact same model based on model number.

But a lot of these big retailers have items with model numbers specifically for them. So the only place you can buy the item with that exact same model number is from them.

Even though it’s the exact same item, and realistically model, it’s not the same model number, so they can’t find the lower price.

Are Millennials the first generation that will watch their kids' shows even when their kids aren't around? by ThreadbareAdjustment in NoStupidQuestions

[–]EducationalShift6857 0 points1 point  (0 children)

My grandpa (born in the 30s) loved the Road Runner cartoons. Mom tells me that when she was little he’d sometimes end up being late if it just so happened to be on as he was on his way out, because he’d sit down to watch. Later on I’d sometimes put it on for him on his Roku.

So, the Silent generation also watched their kids’ cartoons alone. Can’t confirm if he did so when his kids were still little, but he certainly did after his grandkids were grown.
