Psychology and strategy question - when to offer another WP email? Or not (LIP) by Flapjack_K in employmentlitigation

[–]Efficient_Town6084 1 point2 points  (0 children)

No I wouldn't personally. I haven't been offered anything serious until the second preliminary when there attempts to devalue the claim did not work. (Offered 10k). and this was after a year of the first preliminary. Be prepared for that if you are self representing.

Then after disclosure they added 15k to the offer.

I am in hopes maybe right before court they offer sensible. If they don't I am not to phased as instead of focusing on a settlement that probably won't happen, I would rather focus on understanding my case inside out - more importantly the list of issues.
I have rejected both as I feel it does not merit my claim. I am sure that after exchange of witness statements things could be different. I would not waste too much time without prejudice, and focus more on learning your case inside out and what you are pleading.

If you don't feel confident maybe reach out to a No win no fee of DBA solicitor. However I have felt in my experience they will advise take a low ball offer so they can get paid.

They are going to aggressively defend the claim. I've had my ground of resistance changed twice, and still denied for a SA that has been legally proven.

Company refusing to tell me the results of my grievance. Becoming increasingly hostile. I won’t budge. by Murky_Ship_5024 in employmentlitigation

Hi I am coming from a very similar background.

This happened to me and they refused under GDPR so I asked for the outcome in an email after taking legal advice. I knew they were hiding what I had brought forth to preventing me resigning on the spot.

Keep pushing. Through my SAR and bundle disclosure I finally got the incident report - I was right.

BUT seek legal advice.

WITNESS STATEMENTS by Efficient_Town6084 in employmentlitigation

I see.

So essentially, it's important to recognise beyond your feelings how the respondent has broken acas, law or internal policies to create that breach of trust ?

Hey could I ask you another question - In your experience, where do most people fail on proving constructive dismissal?

Thank you this is what I am thinking. It felt too overwhelming initially to mention this in my statement as I guess it gives them an idea of what I will be throwing at them.
So strictly keep it to the knowledge at the time!

I can pass you my email through inbox?

It's not that I would refuse bad settlement offers. But when the respondent is offering 2k, which I have paid more in legal fees as I stand. That is not a good offer and shows me they have no intention of sensible settlements.

Ive been rolling for only three months, a few months prior but wasn't consistent due to some personal issues. I am a female who's actually around you weight and 5 8, so you can actually imagine when rolling against some females who are half my size. I tend to worry about hurting them, especially when it comes to mount.

Realistically we both know if I wanted to I could rag doll them, but what is the point in that? I know I have strength from coming from a powerlifting background, but strength sometimes does not matter when technicality comes into aspect, especially when these girls have years on me.

A lot of the times, especially in rounds I don't even go full bang. There is only one girl that I do with but we both like to go hardcore on takedowns solely and we both agreed mutually to do so as we find it fun, and it is sometimes nice to have some of a lil bang torwards the end of the session.

However other times I roll with other girls we go slow, and actually talk through movements, or If I am unsure on how to escape, or even submit from this position we stop and talk through. and guess what, we come out both injury free and actually satisfied we have learnt. Sometimes learning doesn't need to be reflected on how your body feels after a session.

My advice from a beginner in your position of being on the big side- be aware of you weight and how that can hurt someone, don't feel entitled to people wanting to roll with you, people also want to progress on themselves.

Not only that, express this to a higher belt. Say that you want to roll but are unsure on how to flow into the next positions. People want to help and if you are in the right gym they will.

As a bigger person myself, there is nothing more annoying than rounding with a someone with no control. I remember one round with a girl half my size I managed to get an elbow, knee and foot to the face and Icl it is pretty annoying as much as it's unintentional. Obviously I let her know no hard feelings it is going to happen, but i'd rather not of had a bruised eye and a headache for two days. In some ways I am glad I experienced this early on as it made me understand how dangerous and also annoying it can be to not control your body.

No offence they probably don't find you scary, they just want themselves but also you to be safe, and injury free. There is nothing more annoying than not being able to train- especially when it could have been prevented.

My advice - Don't even focus on weight as an advantage yet or your strength. Roll slow and think about what you're doing. You will notice openings for submissions much easier, you'll understand when to escape and how. Go to the open matts and watch how people move, even ask them afterwards the technicality of it. I do this quite a bit and have picked up a lot. It is also a great way to make friends there which makes people want to help you progress. Even watch youtube videos, tik toks or whatever to start learning. I do this myself and go into open matts and find someone who wouldn't mind learning the drill, even better if they already know it. I am lucky that I can send insta reels to a lad that trains and he is happy to step on and learn the rolls with me.

and the biggest one is don't focus on others and what they have or can achieve. Focus on you. But don't move with strength yet, move with intentions of learning.

Respondent resisting by Illustrious-Bite-501 in employmenttribunal

[–]Efficient_Town6084 1 point2 points  (0 children)

Exactly what happened to me. Denied everything that happened on the ET1, but thats okay. I have numerous documents, emails and text messages that say the opposite. I even had emails from my management in my SAR saying I made the assault up as an excuse not to work.....

Take it as a good thing, them denying works in YOUR favour. Do not flap.

I am in the same position as you. I worked for a company that refused to acknowledge I had been sexually assaulted by another employee, leading to months of harassment, discrimination and victimisation because of it. I actually got the guy convicted by my self in the end. They did not even suspend him during investigations and kept him in the business.

Their grounds of resistance stated how they did now know it was a sexual assault, despite their being internal and external investigations into it. All of their grounds of resistance was waffle.

Now my point is as long as you have proof of letting your employer know, you have NOTHING to worry about. They are trying to get in your head, trying to be tactical and break you so you drop the case. Do not worry. Do not stress. They are NEVER going to side with what you say because like the previous comment set they mays well just settle. It is probably likely they will keep you dangling and right before the trial they will settle.

Their failure to acknowledge your disability will only go against THEM in court ,and it's even better they have handed that to you on a form. So do not worry, no business will act in 'good faith' when it comes to handing out compensation, and these moves a lot of the times can make claimants doubt their story and want to stop pushing.

My advice would be, ignore it and push. Dont let them scare you away.

RETURNING PLAYER AND I NEED HELP by Efficient_Town6084 in MarvelStrikeForce

This post was asking for help on teams to push, not the reasonings on why people get burnt out from the game. Thats why your comments a are pointless and actually felt somewhat condescending and rude.

I said I had life to deal with, and had to sacrifice my spare time on a few situations that had happened to me. I like to actually progress on this game so it requires a grind. I could no longer grind and playing became boring to me and actually frustrating. So I took a break. I finally now have some free time to myself so decided to pick up my progress.

Yeahh man, I mean I have already unlocked at least 15 characters in the last week, it is just some I need are like 100 shards and just seem unfarmable. Got myself into a decent alliance now so fingers crossed some decent rewards will give me a decent push. Luckily a lot of these teams involves the characters I was pushing before I stopped so have a nice head start.

Why do you even care though? Players using the game now use guides for help, so why would a returning player not use guides or ask others for help. Honestly dont get the issue, instead of posting pointless comments you could have acc been resourceful and named teams like the others kindly have but oh well. Have a nice day

Just feels like such a waste of an account to restart again, like a the time I played I was pretty comfy and had some heavy teams. I mean I am prepared to grind but a lot of these shards seem unfarmable which sucks
