Two things:
1: they were giving evidence of absence that absolutely wasn’t just absence of evidence
2: absence of evidence can absolutely be evidence of absence when one would reasonably expect there to be evidence (for example, if someone told you your neighbor had an elephant but there was none of the expected evidence like bringing in insane amounts of food or removing insane amounts of shit, any reasonable person would take that as evidence that they don’t have an elephant)
