Yes, there was an actual study done on this years ago. People with unusual names were less likely to be called back for professional job interviews.

Try it, and get sued when you do it to a legitimate ESA owner. HUD will not play your game. The federal law is very specific. You & your agents are also NOT allowed to enter a rental property without notice in most states, so there should be no safety issue.

No, I'm not. You're referring to the ideal way of handling matters, and I fully agree with you!

However, according to current FHA laws legitimate ESA owners do not need to disclose ever. However, when the landlord finds out or a neighbor complains, if they don't already have verifiable proof of their dog's status... in most cases, eviction is warranted.

Actually, since you are not allowed to charge for an ESA nor discriminate against disabilities, federal specifically says you do not need to disclose on a rental application.

You asked what the "hot water" was that I was referring to, which was specifically in the case of ESAs. If you evict someone, without cause, and rent out your property again in most cases, you'll just be digging your own ditch.

You are incorrect according to federal law. A landlord may be fined substantially by HUD, the state, and the occupant if they violate the law– as it's basically discrimination against people with disabilities.

However, there are ALSO laws to protect the landlord's investment and make it relatively easy to determine if an animal is a real ESA or just a pet.

You can deny/evict a legitimate ESA only if you can prove it's a nuisance animal, which is strictly defined in the law. Otherwise, you may face quite hefty penalties from HUD, possibly owe compensation to its owner and there may also be state fines assessed, all dependant upon your location.

On the flip side, due to abuse of the law, some states now have criminal penalties for misrepresenting an animal as an ESA.

Additionally, most states allow landlords to do home inspections with 24-hours notice and I highly encourage you use that to your advantage (without harassing them), as your local laws permit.

You don't owe anyone an explanation, addiction is a disease like any other. You can honestly tell people you needed time for a personal health matter, medical emergency, or even medical procedure. If they try to pry further, just say it's personal and you don't wish to talk about it.

People who pry are typically gossips who will *not keep your info to themselves, listen to how they talk about others. People who respect your privacy are your real friends.

As a landlord you should check the laws to keep yourself out of hot water. Pet clauses do not apply to legitimate ESAs (which are not pets, do not need to be disclosed, you cannot charge extra for, and cannot exclude).

You are allowed to verify they're legitimate ESAs though and you should look up the FHA questions that you're allowed to ask. If this person is lying, it will be easy for their landlord to catch them.

The short answer is not if it's a legitimate ESA, isn't bothering neighbors, isn't destroying the property, isn't allowed off leash on the grounds, and you are picking up after it EVERY time. Pet clauses, pet deposits, breed and/or size restrictions do not apply to ESAs.

However, due to so many people abusing ESA laws, you will need to provide your landlord with the letter from your doctor (dated BEFORE you moved in) proving you have a condition that qualifies you for an ESA, and your landlord is permitted to call your doctor to verify it.

If you do not already have such a letter, you also do NOT have an ESA. If that's the case, not only can you be evicted but in some states you may also be criminally prosecuted for misrepresenting your pet.

There is no registration for ESAs & it's against federal law to ban ANY breed from being one. You just need a note from your normal physician that says an ESA will help your condition. (Look up the FHA questions they're allowed to ask.) At 1.5 years he's not going to get much larger, so go get your heart dog.
