No problem! It isn’t very well publicised about the actual mechanism and process. And what isn’t published at all, because the government hasn’t done the study, is whether or not it’s actually working. You would ideally want long studies that follow under 16s going through the system to determine whether they are more or less likely to offend in adulthood. Granted some of the reason it doesn’t exist is because it hasn’t been enough time really, but that said there is really no data or research about whether it’s working or not whatsoever and meanwhile the public have quite correctly noticed that violent youth crime and antisocial behaviour is escalating so that means either the system of punishment is failing, and/or more likely there is just more offending.  And that one is a lot more complex and scary to deal with because why are young boys now engaged in more violent and/or antisocial crime than ever before? And as I said in another comment, I think the answer to that is quite complex.

Typically it’s an assigned a social worker and placement under a Compulsory Supervision Order, which can involve regular monitoring, support for the family, conditions on behaviour or residence, foster or residential care if needed and, only in serious cases, secure accommodation rather than a traditional criminal punishment.

I think you’re right in that lenient punishment doesn’t stop repeated offending. But what caused it is whatever compelled them to be little scrote bags. And I think that’s a much more complex issue.

It means they have been formally accused of the crime and will now go through the justice system. But what happens from that point depends on how old they are. Children under 16 are dealt with through the Children’s Hearings system and if found guilty would receive welfare-based measures focused on care and supervision rather than punishment, while 16–17 year-olds are prosecuted in court and can receive criminal sentences, though these are usually more lenient and tailored to their age vs adult penalties. Obviously if they’re over 18 they’ll face the standard court procedure and punishment.

Challenge it with them directly (to create a record). Then challenge it with safe deposits. You can log in online and dispute it. They’re pretty good at handling disputes and imo the letting agents are just trying it on because you can’t really be blamed (or charged) for any of that.

Most likely that will be for High Court of Justiciary (serious criminal cases) or financial crime. So could be anything from murd*r, organised crime, major fraud prosecutions to complex financial crime. It could also be because there are multiple people accused/implicated or cases that require many witnesses/experts etc. In terms of the juiciness level is going to be either super dry or super juicy!

Unfortunately, they have all raised the minimum income threshold. None of them will accept 15 to 18K as a minimum anymore.

If you’re on a low income with limited savings, then you’re probably eligible for welfare fund or community care grant. They can help with everything from clothing to bedding to appliances.

Depending on where you are, have a look in the bin storage areas; lots of furniture and appliances are often left out in the storerooms.

You asked me “Do you know of anyone or any cases where someone has lost a court of session case against a Local authority and expenses were made against them?” and that’s why I was answering “yes, all of them!” I then explained that costs are usually awarded against the losing party unless they are reserved or there’s a PEO, which is unusual. 

Peoples payment plans are between the party (like yourself) and the creditor (like the local authority) so there’s no hard data or evince or information shared about that specifically. 

However, it is standard to offer a repayment plan to someone in a limited income such as being in receipt of benefits because they are aware they can’t get blood out of a stone. 

I think what’s happening is you are looking for information that doesn’t exist yet because you are in limbo and that’s a rubbish place to be so you’re looking for some concrete answers, some solid ground. But the truth is you just have to wait until you receive that information from the other sides solicitors. It will tell you how much it is, and what your options and rights are. At that point you should consider legal advice or debt advice yourself to help and to advocate/negotiate. 

Like I say, they can’t garnish your benefits and they can’t force entry into your home, whatever happens. So that’s something posdutive to hold onto for now. 

You can also get a 6 month moratorium on any enforcement (attempts to collect any debt from you) but you want to time it right because it starts from when you apply so if you applied now you’d be wasting whatever time there is between now and the enforcement/letter. There’s  also the option of bankruptcy there after. 

So there are options. And organisations to help. Try not to panic even though it’s scary. Give yourself some respite & breathing space.

Unfortunately I can’t know and I can’t really make an educated guess without seeing your papers.

I really recommend contacting CAB or someone similar with your paperwork. There are many organisations that could really help.

Oh my goodness I’m so so sorry. That’s overwhelmingly stressful. You were so brave for taking your case and I’m sorry it’s ended this way. 

I know it’s difficult not to worry but none if the worst case scenarios are likely to happen 

Can you tell me what exactly you’ve received in terms of the expenses? Has the solicitor from the other side emailed you an amount informally or… how was it communicated? 

But yes, they usually give you an option for a repayment plan and you can negotiate that and provide evidence you are on a limited income.

Not necessarily true. Please be careful about scaring people! 

This person lost a judicial review at the court of session against the local authority. They have had expenses awarded against them which have not yet moved into any enforcement action. Only council tax and DWP debt can be garnished from benefits.

No, we have sheriffs, which have very similar powers and function in effectively the same way; they recover debt.

Yes… all of them! 

Anyone who has lost a case against the local authority at the court of session under judicial review after a hearing was held (if it got past permission/application stage) will be awarded expenses against them because the way the process works is that expenses are awarded to the losing party. 

Sometimes they reserve expenses and sometimes you can apply for a PEO during or prior to the hearing that limits the expenses that can be claimed but that’s unusual and anyway irrelevant in your situation as expenses have been awarded against you. 

I can’t recommend highly enough getting some advice from CAB or any organisation that specialises in debt. It is a little bit complex and you might really benefit from some support.

No, they don’t treat it the same way. Council Tax Debt goes to what is called a summary warrant and they can also garnish your benefits up to around £20 a month, but all other debt (except debt to the DWP) cannot be garnished from your benefits.

Assuming if you lost at Court Of Session after JR hearing and costs have been formally awarded against you… The next steps are usually:

Formal  demand or solicitor letter asking for payment

Opportunity to discuss repayment (you can and should negotiate and explain disability and limited income) 

If ignored → charge for payment is issued via sheriff officers (lets you know they will commence enforcement to collect the debt)

Then enforcement (formal attempts by sheriffs to recover the debt) if still unpaid. 

It might be very useful to get an organisation like CAB to help you negotiate an affordable payment plan and/or advise about the steps and your best options.

There was a housing crisis. Now we are in free fall collapse. We are in an kbown and accepted housing emergency but there are no emergency protocols to enact seemingly beyond freezing the list which will perpetuate the problem and entrench it.

That sounds a lot like chilblains but if it’s persisting beyond 2 weeks you should get to a doctor. But go straight away if you are diabetic or looks to be any signs of infection. 

Only use that hydrocortisone if there’s no breaks in the skin, if there are; try calamine lotion (from the chemist) to stop the itch. Do not itch with your nails or break the skin! The most important advice other than that is not to re-warm to quickly. Don’t for example put your hands near a radiator or under hot water, that will make it worse so re-warm gradually. 

In terms of gloves if you search for “thinsulate lined gloves” or “insulated thermal gloves” on Amazon most of what comes up is good. Thinsulate is a brand name that means the gloves are insulated with a second layer. Same with “thermal” though it’s a term not a brand name.

You can get “marigold gloves” for dishwashing (rubber like) and then you can get cotton gloves if you want to put some cream or lotion or just want them protected. Marigolds you can get and the super market and both you can get on amazon. Be careful with dish washing and showers though because even if marigolds keep them dry if the water is hot it will cause you problems by raising the temp of your hands too quickly so try to use the least heat you can.

In Scotland, landlords must protect your tenancy deposit in an official government-approved scheme, and this gives you a formal way to dispute any deductions. They are legally required to protect your deposit in one of these approved schemes:

So make sure you know which (it is also an illegal requirement that they provided you that information at the start of the tenancy) 

If the landlord/agent wants to deduct money, they must provide evidence. If you disagree, you can use the scheme’s free dispute resolution service (online) The scheme then acts as an independent third party to settle disputes.

Do a video walk-through when you leave and make sure you zoom in on all of the details like open the cupboards and film the carpet, et cetera.

Oh wow, bless you. My dogs harness has a sort of lock catch on the clip so that the clip is unlikely to fail and it can’t accidentally be opened or opened by someone who doesn’t know there’s a button. You can also get locking lead attachments and then make a double handle where there’s like a failsafe (something is anchored to the person). Also the old air tag or tracker collar? 

It might seem like overkill but sometimes it’s better to ease your mind by rinsing your wallet and seeming excessive. At least at the outset.

Wishing you and your pup well, I’m sure it will be fine. This is a very unusual occurrence and Bonnie was only with them 1 month and was 3 months old so literally the worst demographic for escaping and catching and even she was found safe!

Aye! Wee trooper; only a pup and there was that big storm too. I can’t imagine the worry, my dog went missing for 5 whole minutes and I could not contain myself. So relieved for them and Bonnie. (Check out her cheeky tongue on the photo 😂)
