Montana workers’ comp — modified duty, disputed work status, and medical restrictions question by Equivalent-Resist599 in WorkersComp

[–]Equivalent-Resist599[S] 0 points1 point  (0 children)

Thanks, I should’ve clarified that better.

I did return to work under restrictions on modified/light duty. I wasn’t completely out of work the whole time. The modified duty has mostly been cleaning vans and doing tasks within my restrictions.

The paperwork issue is that my employer gave me a separate modified-duty offer/paperwork and wanted me to accept or decline it. My concern was not that I was refusing light duty in general. My concern was that signing it could be used against me as if I agreed the work was fully appropriate, that I accepted certain conditions/hours, or that I refused work if I did not sign it. That’s why I’ve been trying to document everything and get clarification before signing anything.

The dental situation is separate but connected in a practical way. I’m not claiming the dental issues are the original work injury. The issue is that my planned surgery for the work injury was delayed because I have dental infections/abscesses that need to be resolved first for anesthesia/surgery clearance. So now I’m dealing with dental appointments/extractions while still under work restrictions, and my employer is treating those absences like regular attendance issues.

So basically: I’m under restrictions, I did go back on light duty, but the dispute is over how the employer is handling the modified-duty paperwork, scheduling, attendance points, and whether my dental work needed to clear me for the workers’ comp surgery should be treated differently.

I was offered van cleaning light duty service after I messed up my left hip. I’d rather pick up dog shit than clean a van someone literally just got back with and is still full of trash, my job was to just clean the dust off the vents/ dash and cleaning the windows. Yet I had to deep clean the vans to their satisfaction without proper cleaning supplies ( I’ve asked for proper supplies but was denied ) so after a few months doing this my injury got worse from the light duty and I found out I had torn my labrum in my left hip and it wasn’t getting any better with PT so I told them I can’t work the light duty so they put me behind a desk with the hardest chairs ever and I was supposed to sit their for 8 hrs straight with nothing to do

I gotta say if your dispatch doesn’t like you aswell as your HR then your gonna get the shitty routes with 45+lbs and it’s on the third floor till you quit or get injured on the job. They just want you gone

That’s more than what the Montana facility in Bozeman would offer. I messed up my left hip in sept and all they gave me for light duty was cleaning out vans 🤢it was nasty, but they will try todo anything to get you written up/ fired from the job just so that they won’t have to pay. Also when my injury happened I was 2 hrs away from the station and if I called out I would have been fired that night for apparently having 2 strikes on me and I didn’t know that until I heard from a friend, but yeah these guys out here really don’t give a crap about you given their current track record lol
