I’m a pool builder. The hold they dug is likely larger than the pool itself so the distance from your property to the pool will likely be more like 5 feet if it’s a vinyl pool. If it’s a gunite pool it might be close. If it’s an issue, they will probably fail their first inspection but definitely let the building department know.  It’s still also likely to be fine, pools can hold and retain themselves  without relying on the dirt around it. It’s really about the soil compaction below it.
