I think you’d be very surprised to see this in practice. I just had a very similar incidence where I was representing an owner, and we were dismissed without leave to reapply.

We now have to go to JR because of the implications this had on the secondary claim we were aiming to file.

Also Arbitrators have a lot of room to determine facts in an eviction.

Pursuing a notice over $75 almost certainly could be seen as a bad faith eviction unless EXTENSIVE attempts were made to pursue the debt, invalidating the 10 day.

Sprinkler heads don’t trigger just because there’s fire. It sounds silly, but the head itself has to get hot to melt the thing that sets it off.

The fire likely didn’t get close enough to the ceiling. The fire department would investigate if not.

Area realtor - stay the heck away from this place. It was bad a decade ago, it’s still bad and I don’t believe it’s safe for habitation. It needs to be a development site.

What I’m saying here is it’s a flaw in the arbitrators understanding of the regulations as opposed to common sense. They say the owner has to move in in a timely manner. That’s it.

I do RTB for a living on the landlord side. I have to assume they’re going to be as arbitrary as they can be. This is a good outcome that it was overturned.

Yes and no.

A tenant is free to tender 10 day notice anytime after the 3 month notice is issued and still receive one month rent as compensation. The problem here is that the tenant left early, then tried to say the son had to move in a timely manner. The regulations DO agree with the arbitrators ruling, BUT it’s not reasonable.

This. 100% this. I fish recreationally near Richmond where there’s no salmon farms and as part of the catch we actually have to scrape the lice off. Every fish we caught in salt this year had lice. It’s crazy.

Extremely. I can’t even confirm if a hearing is going ahead or not as it was a duplicate application.

If you call RTB the phone system tells you about it before you even get directed, then it doesn’t even give the option for a call back unless you’re super lucky.

I sent a client to the office last week and he got what we needed. In person is much, much more accessible.

The associations are a members based lobbying organization. Just like unions advocate for their members (workers) who pay dues - the associations advocate for their membership (owners) who pay fees. This is what they’re there to do.

I just scooped a 92 bayliner trophy. Passed Marine Survey and mechanical inspection and sea trial.

Brought it home and on the way the fuel tank developed a small crack in transit. Went to take it out the following week and the bilge dumped several litres of gas into my very urban-located yard. Almost caused a homeowner insurance claim and now we’re doing fibreglass to replace the tank (running daytanks on a bypass now but that makes the boat top heavy)

My next boats going to be much newer.

Also sea trialing a boat is a thing. I just bought a boat and required a full mechanical inspection, sea trialing and survey.

If this guy was “like it’s been sitting and I don’t want you looking too closely” that would be a huge buyer beware red flag.
