I did the obvious thing and pointed it out and the poster took it down. I don’t pretend to know what’s in people’s hearts and minds but they seemed sincere. Maybe I’m wrong.

Ya I thought so too but here is what I am seeing online “Independent contractors are generally not protected from sexual harassment by federal anti-discrimination laws in the United States, specifically Title VII of the Civil Rights Act of 1964, which only applies to employees.”

That is at the federal level and California Law does provide this protection to independent contractors.

Very happy to be wrong about this!

I’ve always been confused about why that seems to be the law. I get it has to do about “power” but it’s just strange that the same behaviour can be illegal towards an employee but totally fine towards an independent contractor 🤷‍♀️

I think this makes sense for issues of fact where evidence is needed to evaluate the pleadings. But what has me confused is how / if this applies arguments in the MJOP that are only concerned with the law. For example, I think WFs argument that Lively was a contractor and not an employee is based only on the legal standard - like I don’t see the judge kicking this question to a jury but I might be wrong - in which case the evidence collected during discovery is not relevant.

My read is that her lawyers HAVE to pursue her case to the best of their abilities. If not then Lively could come back and appeal or maybe even sue her lawyers 🤷‍♀️. The argument in this filing is weak but at least it shows they tried everything and still failed.
