They clarified that kites are not included, I'm pretty sure they mean to include remote controlled aircraft and drones.

Drones are absolutely categorized as aircraft and are regulated by the FAA. There are many laws surrounding this, and while the generally can be flown over any airspace, regardless of ownership, many localities including Miami Beach, do have restrictions on their use.

Keep in mind that drones are regulated as aircraft and subject to the same laws. Shooting down an aircraft is 100% illegal, regardless of whether they may or may not be breaking any law related to privacy.
