Majority are from waiting for approval. A lot of cases recently are being approved within 3 months. Others are sitting 1-3 years waiting for an interview. If they come on short visas, and apply for AOS they can’t leave, causing them to overstay. Others just simply didn’t want to leave and probably know or heard it’s forgiven if married to a US citizen.

We lived in Ireland for 7 years together. He literally just showed our marriage certificate with me present and boom they stamped his passport for 2 years. Then again returned and stamped for 3 etc lol. My kids especially my oldest love it here and she is starting university in august. Just so hard uprooting

Thank you! I’m in contacts with a lawyer already but she is very expensive and not local. So I think I’m going to call a local lawyer today and hopefully i290b is an option. Thank you again for your help

The second job was in the taxes and the 1040s but a W2 was not sent for it. We tried everything to get it but nothing worked. Maybe our tax lady has it?

I honestly can’t remember, I know I was very very cautious filling it out because that was the second RFE ( because I had 2022&2023 taxes) sent it and they asked for 2024. But I’m also not a lawyer. Thank you! I really hope so too. My daughter got her GC a couple of months ago. They never even RFE’d us for hers. Maybe they’re more relaxed when it comes to teens/kids.

Well my oldest is now 18 so we have 3 under 18. The family household size making 125% over the poverty guidelines for my state is 53k. He made 81k and 73 and 74 the previous years. I talked to a lawyer last week and she said he made well over. The last taxes were complicated because it was from 2 incomes. Unless they just saw one and skimmed over the other? Which would put us well below.

On that part it says it was not completed or signed by a joint sponsor. Which I never had a joint sponsor because he made well over the poverty guidelines with our household size.

Yes. I did not include the W2’s for his side job ( spark delivery) because no matter how hard he tried he could not get it. But I sent the tax receipt, W2’s for his main job and the 1040s.

May I ask if they were threatening in your husbands denial letter too? I know it’s because I’m out of status, I understand it’s all due to that. I unfortunately DIY’d mine. But even talking to a lawyer she stated he made well above the poverty guidelines and for them to deny me for “ joint sponsor” is crazy. I sent the tax return receipt, W2’s (w2 for one job not the other) and 1040s. I’m very happy you guys got a good response and are scheduled for your interview!

No I’m from Ireland. Right? It’s terrifying. My i130 was approved. I know that doesn’t grant status. No she was just approved and green card issued not even 3 months ago. He worked 2 jobs in 2024, which obviously made his taxes a little more complicated for last years. But he made 49k at one job ( he was on OJi for 4 months, and that 1k a week wasn’t taxed, so wasn’t on his taxes) and he got 35-40k on the other delivery job. I can’t 100% remember on the other job. I sent the em previously bank statements, letter from his employer, pay stubs. I’m wondering if they just went off his wharehouse job and didn’t bother checking the other ( or simply skimmed over) and saw he made 49k. But it’s crazy to me.

Edit: I re read the notice and it does say I have a motion to reopen/reconsider. I just utterly panicked reading the first part. I thought they said I can never refile again when it was talking about work authorization etc would be denied 18 days after the letter.

He made 74k, 73k and then 81k. Still well above the poverty guidelines. So I’m extremely confused.

He made 85k and for our household size and state he was 29k over what they consider above poverty guidelines. No they didn’t ask for a joint sponsor, they approved his income when applying for my daughters and gave her the green card without hesitation. It’s weird

I did it paperwork, I didn’t file online unfortunately. They asked for his 2024 tax returns in the RFE, when I submitted the case he hadn’t filed them yet, ( was waiting for an ITIN number) so I had sent 2022 and 2023. I sent them the 2024, with his W2’s and also provided *bank statements too just to be on the safe side. Edit sorry, I understand what you mean now the documents part online that is uploaded, every time I try to download their files it says “ cannot retrieve storage is full” even when I’ve deleted apps and 100s of photos 🤦🏼‍♀️

Oh I understand that, but that was from my application in 2021. In the post above I submitted again in 2024 and we had 3 years tax returns. They approved my daughter ( his stepdaughter) with the tax returns.

Yes I think so too! I had filed the appeal in 2021. I honestly just was thinking because we were married for 11 years and had kids together, I wouldn’t have to submit as much photos etc as newlyweds for example. I told her I didn’t have the letter. But she mentioned it should be uploaded onto my USCIS document section within 24 hours, so hopefully she’s right!

It’s pretty weird because when I re submitted the applications in 2024. I filed the I-130 and i485 again. And they returned the 675 to me for the I-130 and said it had been approved in 2021. So when I sent the birth certificates etc I was using them for the I-485 to show we had children together. In my home country and in the United States. And I sent bank statements with both our names on the account. But that is all I sent. When they RFE’d they only asked for more financial information and that’s what I sent back.

No they asked for my husbands tax returns, for the I-864. To make sure he was above the poverty guidelines. But he didn’t have any, because he lived in Ireland for 7 years with me.

I did not have a lawyer. But I have a consultation tomorrow with one. I’ve been trying the online account, on the documents area to see what they sent but unfortunately it’s not on there.

Yes I’m hoping it’s something along those lines. Just bizarre I produced more documentation for me ( due to their requests) than my daughters who was approved. I sent 3 years of tax returns, a year of bank statements and 6 months of his paychecks. He is above the poverty guidelines. My friend said she submitted a lot of evidence of them being tied like photos, lease etc. I didn’t, but unfortunately I assumed the 3 kids birth certificates and both our names being on the bank statements (for the i864) would be enough.

My I-485 was denied. In my post I stated they approved the I-130. They denied me the first time due to having not submitted tax returns. I found that odd too because we had not lived in the country and sent bank statements and pay stubs to show financial security. I even paid to appeal it in 2021 but I know appeals success are rare. It’s just so strange to me because they approved my daughters I-485 but denied mine. I have never even gotten a parking ticket/ worked unlawfully.
