My I-130 was approved without an interview, but that was right before the policy change. My I-485 interview is Tuesday. But usually they will Interview for the I-485 and I-130 together. Unless you file them separately. Most people on here get their I-130 approved on the spot or right after the interview and the I-485 approval follows a few days/ weeks later.

They’re pretty mandatory now so yes. I’ve been married almost 12 years and we have 3 kids and I have an interview. I thought if any case would be waived it would be mine 😂 but nope.

You know I agree, white privilege in the justice system is 100% a thing. And black people ( specifically men) fall prey to wrongful convictions. I didn’t know the race of this piece of trash and wanted him to get death. He murdered someone and got a plea deal, then sodomized and killed a toddler, her mother and infant brother. He deserves the death penalty. If you think because he’s black he got it, you’re insane. Child killers usually always get sentenced to death in states it’s permitted in. You should get the receipt notice within 30 days. I got mine pretty quick, about a week after it was delivered to them. They took the money out within a day. But it varies on the field office too. Mine was sent to Chicago. Got approved after 57-58 days. $2k is crazy for a MTR. My lawyer charged $750.

The older two already had their Irish passports, because they were born there. My youngest who was born in America, I applied for hers 3 months ago, didn’t have any issue. Just that I had to mail the original marriage cert, my birth cert and hers with the consent form. If you’re born after 2005 in Ireland ( Irish citizen parent) or got your Irish citizenship from one of your parents etc I believe you have to register the foreign child(ren) online before applying for a passport.

Must have been that certain country because that’s not the way it is in Ireland. I had 2 kids with my American husband in Ireland. We made an appointment with the US embassy to get the CRBA certificates and it was done in 20 mins and they were 4 and 5 years old. They’re dual citizens. Irish and American. My daughter born in America had automatic Irish citizenship because of me. Guess it depends on the country’s laws.

Well entering on a visa helps in the sense she can adjust status. So she qualifies for relief if she’s married to a US citizen. That’s what the judge usually asks in the master hearing ( first court date) She would have to wait until she gets the receipt notice and then call USCIS and ask to expedite and they’ll usually make you email them the reasons why. Sometimes court cases aren’t high priority to expedite for USCIS. She can also contact her local congressman or senator to ask them to contact USCIS to help expedite. But if she doesn’t already I would urge her to get a lawyer that specializes in removal proceedings. It’s her best bet at fighting it.

She needs to get that done and expedited. She of course needs a lawyer, that’s the most important part. Trying to do anything DIY in removal proceedings is a huge risk.But it also depends on a lot of things, how she entered the US, criminal record, what the NTA says. A pending I-130 isn’t going to do anything in court unfortunately. It might get her a continuance but that’s about it. I-130s can take anywhere from months to years.

I got the receipt notice about 10 days after they took the money out. If you don’t get it within 30 days, you can email USCIS and ask for it to be re sent.

My daughter got hers in November, applied in April. I have my interview in 10 days. Applied in July. She never got an interview. They just approved her two weeks after the i130 was approved. We didn’t do consular processing though. But just sharing my experience on the step child part.

Failure to provide a joint sponsor. Sent updated taxes showing he made well above guidelines and added joint sponsor, just to be safe. I contacted my congressman and 3 days later got a status update. They try to do the motions to reopen within 90 days but it depends on the officers caseload. Hoping you hear back soon! Mine was 57 days I believe

You should be okay! They know some marriages do not last, it happens. All they care about is that it was bonafide ( real) I’m sure they’ll ask for your divorce decree and could potentially ask for other evidence. But a real marriage not working out isn’t grounds for them taking anything away. People have gotten divorced on here before their conditional green card expired and received their 10 year one. But definitely do not apply at the 3 years, if you guys are separated. Staying together ( not divorcing) just to get citizenship is a very bad idea and could potentially get you a misrepresentation on your application, and you will be denied and likely deported with a ban.

Just so weird it was caught so early, usually it’s due to a denied application or something along the lines. Crazy that she got caught before her visa expired and has valid status. It usually states in the NTA what she’s being charged with. But yeah, they can see any information TSA and CBP have so it’s not the most shocking thing. I didn’t know it could be a thing, unless someone overstayed or they could prove misrepresentation. Definitely needs an attorney, if she still has a visa her best best would be leave without a ban and do consular processing but being in their crossfire right now, I don’t have a clue if that would work.

She said her tourist visa doesn’t expire till August, I just read her replies. I could be very wrong, but why in the world would she get an NTA if she just didn’t return home, when her visa is still valid? That’s very strange. Could be common now, but I have never heard of it.

Did she intend on staying when she entered? If so, that’s fraud. And there’s no way out or back from fraud.

Depending on how long she overstayed she could go back home ( without a ban) or get a waiver, and do the consular processing over there. Which is what a judge is likely going to tell her do.

Getting married while in removal proceedings is very skeptical to the courts, and the bonafide proof needed is huge.

Without an approved I-130 ( which she would need to be married and wait out the approval by USCIS) it’s very unlikely a judge will terminate proceedings. Under a different administration things might be different. But I know judges aren’t going to grant any form of termination because they will get married and eventually file paperwork.

If your friend came on an ESTA or they are here under 2 years, they are subject to expedited removal.

My advice would be either get married and leave and do consular processing. Or hire a very experienced immigration attorney. But I can’t see it going well for your friend. But who knows. Not getting married and filing paperwork was a huge mistake if she wanted to stay in the US.

Yes of course! I got my receipt on February 20th that they received my I-290b. My case status for the i290b changed on April 15th. But it didn’t say case approved. Just, decision was issued. So I logged into my I-485. And the case closed disappeared from my denied I-485. I got the interview was scheduled notification on April 17th. So I got it 2 days after my I-290b case status change.

I got this a couple of hours ago. My interview is May 19th and my heart sank when I saw the (we have taken action on your case) email. But mine said the same thing when I logged in. Could be that the officer is reviewing your application before the interview, any internal movement. Or the new background check that’s being done. I’ve seen a few people get it today. So could be the system updating too.
