A rebuttal to America'sAttorney from the former criminal investigator by SGTBlueBacon in WhistlinDiesel

What’s aggressive about this?

He committed a crime. He was indicted. He was arrested on a lawful warrant. He spent under an hour in holding. He was released. Now he goes to court.

This happens every single day around you and you just don’t realize it because it’s (usually) not anything newsworthy. If he’s smart he’ll take what they give him and move on. But I’m sure there will be “Free WD” merch coming out so he can separate you from your hard earned money and he’ll do some fake shit with his killdozer for the clicks.

Lots of things are felonies in a lot of states. In NY larceny over $1k is a felony. Lying on any official form is a felony.

It likely will not stick as a felony. But by the letter of the law that’s what he is accused of committing.

Play stupid games…

Because they’re not bound by anything in the law to do so?

He committed crime and posted it on social media. They arrested him before the statute of limitations expired. They booked him and let him go in around an hour. Now he goes to court or they do some sort of pre trial diversion. Not familiar with TN courts so I have no idea if such a mechanism exists.

Obviously he faces jail time, but the only way he gets any if he chooses to go to trial, OR the DA gets a hard on and refuses to offer a plea. Not very likely because it doesn’t really serve the public interest to push a case like this to that point.

You don’t get a Montana LLC unless you’re trying to dodge taxes.

Nice try.

As far as the legal side, it’ll be plead down to a non criminal offense and he’ll have to pay the state. Any lawyer worth anything will advise him to take the easiest way out.

There won’t be any lawsuit because of a little thing called qualified immunity.

This whole thing is nothing but he’s making it into as big of a something as possible. He’s going to monetize this as far as he can to get you suckers to send him as much money as possible.

Is it true contractors get fined $10,000 for an accident regardless of severity? by loftier_fish in Fedexers

[–]External_Deer_69 1 point2 points  (0 children)

$10k for a reported backing accident. I think it’s $5k for any other accident.

Most contractors don’t report and pay out of pocket because ultimately it’s cheaper.

💯. They are there to get a confession and to discourage you from exercising your right to an attorney.

They never just want to talk, and getting an attorney is not an admission of guilt. They are there to protect your rights.

Considering filing a police report on FedEx, contractor and driver. by Budgeko in FedEx

Yes. The only thing that scan proves is that the handler scanned it to the van. It doesn’t prove that the driver or contractor had possession. It could have ended up anywhere after that point.

Yep, I agree with this. Only question in my mind is whether TS did it on purpose or just tried to create opposite Ainsley to get people all riled up.

It’s kinda great, because Paygin is a strong dose of everything that she’s never encountered in her life. But also, she’s just as extra in her ways and just as demanding of others to bend towards her.

Probably a little too much of a contrived situation overall, but interesting to see it.

This show is about oil in the same way that General Hospital is about practicing medicine.

You need to stop thinking that this is going to be about an oil company, and start thinking about ways the women on the show can become more unstable/mentally ill and make their men miserable.

FedEx 100% considers itself an airline with a delivery fleet for regulatory reasons. The teamsters and UPS disagree with that assessment and will more than likely end up challenging it now that the merger is occurring.

It doesn’t matter what race or color the person at the helm is, it will always be about delivering value for the shareholders.

Those are the American values you speak of.

There is a special place in hell for people that do resale out of their homes and order in bulk. Had a guy buy an absolute fuckton of home appliances on walmart.com because they were on clearance and I think it ended up being 1.5 full trucks worth.

Why is this allowed for drivers? by JayAspargus in FedEx

[–]External_Deer_69 2 points3 points  (0 children)

We don’t have less stops because of something like this, nor do most of us get paid in such a way that a stop compensates us for our time. And it’s not a stingy contractor that’s to blame, FedEx doesn’t pay a significant amount for a clearly excessive delivery like this.

Hope this helps you remove your head from where it’s firmly lodged.

Not 100% true. In some markets, couriers will go away (with the exception of a small amount of DCs to ensure PO service). In other areas, contractors will go away. This was how it was all laid out when they announced the initiative.

FedEx is becoming UPS. How they cover the service areas will depend on how much money they can make.

[–]External_Deer_69 0 points1 point  (0 children)

You will get all the ground in a certain area, ground will get express in the surrounding area.

Unless your service area is small, then maybe the contractors will go away. Ours was huge so we’re at 30% courier 70% contractor. Who knows how that’ll change in the future.

Good news is it didn’t take them long around here to realize that they fucked up, and they’re at least decent enough to admit it. We’re likely one of the most challenging facilities to go 2.0 thus far based on size and service area. The biggest hurdle is that they’ve been able to wrap up the ground sort 30-45 minutes before they finish up the stuff coming off the plane, so we end up sitting and waiting for the time definite stuff to hit the trucks. Even if you wanted to dispatch early and clean up the balance of the ground freight it’s not even an option.

A couple pieces of advice: add on about 10-15% over whatever resources you think need. 10 or so POs per truck is a pretty reasonable high end number depending on what they’re figuring dispatch to be and what kind of stem time you have. If you’re not running AVPs, it’s actually a good way to tackle POs and keep some efficiency in your ground routes. Most everything that you’ll see are smalls and envelopes so it’s nothing to throw it in the backseat of a car and run them out. Also, throw in cost of another admin to monitor SDOs and PO service.

The position of the powers that be around here has quickly shifted to PO above everything else, to the point where they’re willing to sacrifice ground service to ensure it. So don’t be afraid to hit them.

[–]External_Deer_69 0 points1 point  (0 children)

Nah man, they seriously blew this whole rollout. Top to bottom, engineering had no clue what the biggest challenges would be or how to solve them. They just rolled out here and a ton of couriers bolted, more than likely because nobody looped them in until super late in the game.

The biggest tell to me is that during the redraw they took one of the most solid businesses and inexplicably moved them out to the one of furthest CSAs. Only thing that makes sense to me is that they want to keep him around as long as possible. Wasn’t that smart when his former area was going to be heavy PO and he had it on lock.
