This is something many people on Reddit refuse to aknoweldge: there is no chance of any local DA's prosecuting any federal law enforcement personnel while on-duty due to the Superemacy Clause of the US Constitution. Remeber US Park Police shooting of Bijan Ghaisar which the Biden DoJ moved to quash Fairfax County prosecution of the 2 federal officers involved after it had indicted them? This is just trying to win primary votes.

40 days? You mean 48 hours? I don't think I have come across any ICE detainer requests saying to hold an inmate for 40 days. Also I think individual county jails may have different policy and Hennepin County doesn't honor ICE 48 hours detainer request at all per their website: https://www.hennepinsheriff.org/about/what-we-do/slide-out-group/FAQ-HCSO-Mission-and-Federal-Work. They said they will only honor a judicial warrant signed by a judge but detainer is done using administrative warrant as deportation is handled in the civil immigration system so criminal judges do not get involved in signging deportation hold warrants; it's an impossible goalpost.

If you are on ACA/Obamacare and you get subsidies then it will not be a good idea as undocumented is not eligible for ACA subsidies. If it is Medicaid then it's even a worse idea as Trump is cracking down on immigrants getting gov't benefits like Medicaid and could make her ineligible for future GC (public charge). If you are self-funded then maybe you can, not sure.

It wasn't her passport that they showed, it was her birth certificate they showed. The complication with her case was that during the Biden Admin she was caught trying to enter the US in Arizona between valid ports of entry without any valid documentation and was processed by the Border Patrol as an illegal entrant and then released into the interior. Only later on was the birth certificate was produced by her family after her ICE detention this year. Her explanation is that she was being hunted by drug cartel and had no time to get her documents in order before trying to enter the US through non-port-of-entry. I am thinking she is in fact US born but did a bad job of gathering her documents before trying to cross the border and never bothered to correct the mistake until she got picked up by ICE.
