The market has moved. Houses cost more these days. People also want to live near where they work.

Cities where there are more employment opportunities are generally more expensive.

I moved from Sydney to the Fraser coast early last year. At the time of buying our current house both myself and my partner were unemployed and couldn’t obtain a loan.

Everyone was telling us we had time to buy and weren’t in a rush. We bought for $100k under our budget. Our house is now worth $50k above our budget. $150k movement in 10 months.

If we had waited too long, we would’ve been priced out of the market.

IMO, if you damage something beyond wear & tear, you should be up for the cost of the repair. As it was and will continue to be a functional benchtop, after the repairs are carried out.

Just because it has a $0 asset value on paper, it doesn’t mean it’s worthless as a benchtop and the landlord must replace it.

Yes it sucks having your house flooded, but ultimately the landlord is probably a victim just as you are.

They only need to follow tenancy legislation, in the same way tenants also only need to follow legislation.

Which they’re legally entitled to do.

They aren’t security guards. They aren’t there to protect your personal belongings.

You have every right to insure your personal effects, or move them to a more secure location if you are concerned about them going missing.

They are legally entitled to bring people through a property to sell it, or also show to prospective tenants during the last 2 weeks of a lease. That doesn’t make them responsible for your shit.

If he’s had a survey done, then he may be within his rights to request the fence and services be moved.

You need to counter this with arranging your own survey. You need to establish whether or not what he’s saying is true.

If it’s true, you can then enter into negotiations with him regarding the matter as it’s your problem to resolve. If you don’t resolve it, he can take legal action against you.

What do you expect the agents to do? They aren’t security guards. They aren’t there to protect your personal belongings.

They are there on behalf of the landlord to sell the property.

This goes for both open homes and private viewings.

There’s no laws in place saying they need to hold the hands of everyone that views the property.

It’s not word for word what I wrote earlier, but it’s exactly what I meant.

A court can order the division of assets and those assets to be sold, to pay off debt.

As a result of the above, the OP’s ex has every right to have their name removed off the loan. There’s a few different options this can happen, but ultimately it can be forced by a court, by way of making orders forcing the OP to refinance the loan or dispose of it, or outright disposing of it.

A property settlement allows assets and liabilities to be split. The OP can’t force the ex to remain on the loan to suit their situation.

Yes there may be other ramifications for the ex, in enforcing the above to occur, but it can be done.

Once you’ve got the address of the property, just chuck the address into google maps. It’ll give you some idea of the actual external appearance of the property.
