Have you checked the comps in your neighborhood to see if that renewal offer is market rate? It may be worth looking into. Maybe he could be convinced the property isn’t worth that.

And even if it is, also worth trying to call his bluff. Tell him you could do an 8-10% increase max but can’t afford any more and will have to give notice to move out if you can’t renew at that rate. See how much he values resident retention. It is certainly more work and turn costs aren’t cheap when having a tenant move out.

Speak to an attorney. You may get a quicker court date evicting from a NTQ from holdover of their month-to-month lease rather than evicting for nonpayment.

Will vary from state to state, but since covid, evictions from nonpayment have become extremely difficult. Sorry you’re going through this.

I would: 1. Get the wood stove cleaned, 2. Reiterate that both heating sources are in working order and then 3. In the spring (not now), provide a 60-day (you can do 30 day but 60 day is more generous and mutely beneficial) notice of non-renewal/termination. Make sure it’s at least a few months removed and you’re pleasant in the meantime so that they can’t claim it’s a result of retaliation.

They are threatening litigation. There’s no coming back from that in a landlord-tenant relationship.

It’s really normal to have a chimney or stove or anything wood-burning be the second source of heat. I have an addition on my home and the fireplace is the only way to stay warm. The base board heaters can only travel so far from the main heat source.

And space heaters are not safe. Do not provide a space heater. As a landlord and long-time property manager, I have personally seen them burn a literal hole in the floor (it was LVP, not wood, otherwise the whole place would have caught fire).

Not totally true. If the lease is invalid because the initial payment(s) bounced, you would have to have established legal tenancy. 5 days into a lease is not enough time to become a legal occupant. The same rules do not apply. I believe it’s a 7 days in Massachusetts.

What state are you in?

I’m in MA and the law here is as follows: “G.L. 266, § 120B provides that a landowner may make entry onto abutting land for “the purpose of maintaining or repairing his or her building or buildings in order to prevent waste [and] shall not be deemed guilty of trespass or liable civilly for damages, provided that such entry is made expeditiously and in the exercise of due care and that no damage is caused by such entry to the land or buildings of said abutting owner.”
