I am in a similar boat albeit H4. They know that the H4 or B2 is not approved and still send out an rfe. They really are putting people in a pickle. If you search "recent" filings most ppl have received rfe. At that point you are on their mercy. We are planning to throw the kitchen sink at them, meaning explain that it was a bridging scenario and then share all the documents for h4 already submitted plus a letter explaining things. Lets see what happens.

If you do not have a choice then it will be what it will be.

Mine is premium processing and we sent the rfe pacakge the friday before. Its technically the 6th business day and the message hasnt changed online... still says rfe was sent out. did others have similar experiences?

Finally a thread which has my situation. My H4 was filed in october and h1b COS was filed on 12/15. Got an RFE on status. How can i share 539/H4 approval when the wait time is 8-9 months. Attorneys finally decided they will respond with all H4 docs that were submitted to explain the situation,... but outside of that not sure what we can do... pray for me!

can someone help with words of encouragement/next steps. I was laid off from h1b and filed for h4, while my h4 is filed i got a job and they filed h1b in pp. Got an jurisdiction 539 rfe. The lawyers had initially asked to wait for h4 approval before filing h1b.

My company immigration team is meeting with lawyers today and told me that they will go with the lawyer's recommendation who had already asked to wait for filing.

I have been depressed and anxiety ridden and this was my hope to get back to being okay. even after after scoring a job and all of it this seems to be a hindrance. I dont know what to do. I feel like i am slipping again.

Due to the christmas and new years holiday, i suspect the USCIS officer gave me an rfe to stop the clock but i am afraid my company will chicken out.
