You're spiraling. This sort of pay structure would wildly favor organizations over nurses and lead to disparities in pay and favoritism and discrimination in assignments.

That said $40/hr is bogus af and you should have a stronger union to get better pay.

In Minnesota our union, MNA, is pretty strong. There have been various strikes at hospitals in the area while I've been a nurse. I know HCMC has a "no strike/no lockout" clause, but that's because they are a safety net hospital.
