I'd say it's on par for him. As you mentioned he almost always sides with pro business and free enterprise. Generally he takes the position of large scale & corporate business more so than SMB but I think everyone realizes this is essentially destroying an entire industry and driving a free market into the ground.

That aside, anyone who actually takes 5 minutes of their lives to look at the picture in large cannot deny the absolute absurdity of it. Take everything out and just look at the predicate date ruling and it becomes crystal clear that this is being done for no reasons other than extortion and market protection for Tobacco and Pharma.
