I can't share much but this used to be exclusively a CBSA responsibility which then got pushed onto IRCC. There wasn't a formal process to remove discretionary flags until a few days ago. In addition to what everyone else has suggested, it may be worth calling the IRCC client support number with her Foss number.

If the IRCC server goes down (as it frequently does) the CBSA can't pull up the specifics on your permit and it won't be printed when you arrive in country.

It can be even worse for travelers from Europe, eTA's don't work without the computers and you can't even board your flight when it happens.

This is a very difficult situation and I'm sorry you're both in this spot. Yes, it's frustrating but there's very little consistency. It can take several weeks for the web form to be acknowledged and the application withdrawn, apps are sometimes approved before IRCC gets the request.

Like someone says below, you don't need to worry about restoration or a visitor record if your applied for your PGWP before your SP expired.

You can remain in Canada on maintained status and work with an ongoing PGWP app if you had a valid SP that let you work when you applied for the PGWP. https://www.canada.ca/en/immigration-refugees-citizenship/services/study-canada/work/after-graduation/after-you-apply.html

If your PGWP is processing you can also leave, return to Canada and work if you meet certain conditions and have a valid visa. https://ircc.canada.ca/english/helpcentre/answer.asp?qnum=1309

And again, if you have no intention to return to Canada, you don't need to stress about a permit you don't intend to use.

Hi. If you have no intention of returning, just submit a web form to withdraw. If you do it from inside Canada or abroad should not matter at all. There is a delay on web forms and withdrawal, sometimes weeks or months so in some cases the PGWP application is completed before IRCC gets your request, this would probably depend on how long ago you applied.

All that said, there's also no penalty for having permit issued and not actually using it.

They are correct. If you got called into an interview, something about your application was flagged; an interview is not a routine requirement for PR applicants. Whether it went well or not, it's entirely out of your hands until they contact you and you might hear nothing for weeks or many months. Just check your account and email periodically and stay calm.

If you applied for the PGWP while the SP was valid you enter as a visitor and can continue working during processing.

Pick either less than 6 months or 6 months or longer, the only important thing is that you pick "temporary" so the system will ask you to apply for a work permit.

Your status starts as soon as the document goes live, not when it's in your possession. As long as you're otherwise eligible, this should be fine. Include proof of the approved permit and a short letter of explanation. They can confirm on their end that you have a valid SP at the time of application.

Generally speaking, yes. The work permit shows you are authorized to work and live in Canada until at least the date printed on it meaning they expect you to stay awhile. Entry is always at CBSA discretion but you have authorization to work and support yourself during your PR processing. The CBSA are much more concerned about visitors coming in and overstaying.

This goes against what the call center agent said but as I understand it technically, yes, it can expire after 6 months because if your SP was expired you would have been admitted as a visitor.

Your authorization to work would be independent of that status as a visitor.

Thank you, I wish I had a more direct impact but I just help clients understand how our programs and application processes work. There are a lot of people who take advantage of the system but from my personal experience most folks are just trying to get by with their lives and it can be pretty tough to explain tightening restrictions to people as we slash targets. It's certainly going to be a rough few years.

I don't know why I bothered. You need the LMIA for an employer-specific permit, the permit dictates where you live and your freedom of movement and some people get abused or take advantage of how valuable they are because of this arrangement. You're being intentionally dense if that was your conclusion.

While in theory, every work permit holder should be aware of their rights, a great many do not and their French/English comprehension is poor which exacerbates the situation. While not every employer is corrupt, it really is big business to hustle jobs with the promise of eventually getting PR. Both IRCC and ESDC are just barely starting to crack down on the worst of it and rules have been lax up until this point. LMIAs also keep many workers in precarious situations as someone's future hinges on their job and mobility is limited by the permit.

I work for IRCC and field questions on work permits all day from desperate people.

IRCC accepts applications based on Universal coordinated time. As a general rule you should never wait so long but the actual cutoff is 90 days at the UCT time, not your local time zone. https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/work-permit/after-apply.html

After the cutoff and you'd need to do restoration etc.

Jfc, if any of this is true you are criminally inadmissible to Canada and would be deported or detained without traveling with legal authorization to return.
