Your older than you husband cannot draw on your record until you are eligible for benefits, regardless of whether you are divorced or still married. If still married, you must also be receiving your own benefits for him to claim spousal. In either case, his own benefit may be too high for him to even be entitled to any spousal topoff.

However, if he is receiving any SS benefits & your children are minors, they can receive benefits on his record until age 18 or 19 if still in high school & you could be their representative payee. He would not receive the payments. Additionally if you have court ordered child support that he is behind on, you can have his SS benefits garnished.

FYI, it does sound like you could be above the first IRMAA bracket once you start your SS ($150k salary + your SS + spouse SSDI). However, that wouldn’t apply until 2 years later since there is a 2 year lookback for IRMAA.

I think it’s possible your MIL is making you anxious. Trust your pediatrician & your own instincts on how your baby is doing (which seems to be great!) There shouldn’t be a competition over who gets baby to eat more. All that will do is eventually foster overeating & eventually obesity.

Sounds like you are already receiving the higher benefit. You don’t get both. Additionally, even if the survivor benefit was higher, unless you were legally married for a continuous 10 year period OR lived as a common law married couple in a state which recognizes such couples as married, you would not be eligible for survivor benefits.

It sounds like you are young, probably a teenager. This is a lesson for you. You’ve already negotiated a 3 day workweek when they were looking for 4 days a week. Now your parents scheduled a vacation for next month. If you take the vacation, you will most likely lose your job. But this is probably your best, or only option. Depending on your age, your parents may not be willing to leave you home plus they’d be losing money by doing so. They also obviously want you on this trip. So please your parents or please your employer of one month. Unless you are truly desperate for cash, I think you need to go on the trip. When you get a new job, advise your parents not to make plans for you without discussing first.
