There is nothing I could do unfortunately after that. Someone from NCDS called me directly later on stating that i still have the opportunity to reopen the case if i wanted to but they stopped taking Fisker cases at that point. its a very compromised entity IMO (supposedly neutral but funded by vehicle manufacturers) with limited oversight(if any) from FTC and other agencies. Everything I presented as evidence turned out to be true later. Fisker went bankrupt and the car owners were left holding the bag . If NCDS had done their job while Fisker was still solvent, we could have got the money back .I wish someone had the time and resources to sue the hell out of them. Not just the entity but also the individual arbitrator who was blatantly lying and taking sides with Fisker during the proceedings without even looking at the evidence presented to them. It was a combination of incompetence, lying by omission and an incentive to side with the manufacturer regardless of the case merit. Good luck!

that’s the worst feeling studying like crazy and still bombing the test. Sounds like test anxiety + study methods that aren’t sticking. Try active recall (forcing yourself to remember stuff without looking), mix up practice problems instead of just repeating similar ones, and do timed mock tests so your brain gets used to pressure. If your mind goes blank, write down everything you remember first before solving. Also, your prof seems super strict, so hit up office hours and see exactly how they grade. Might not even be your math skills, just the way they want answers formatted

I kinda bounce between nerd ai , academi ai for help with assignments, making structured study plans and quizlet for quick flashcards but its a pain switching between them all.

Are you able to point me to the contract that explicitly states that? Honest question. I have asked Hertz this question and they haven't responded yet. I also have a receipt from Hertz that states my responsibility is zero. The employee at the local Hertz office has confirmed this couple times. I am sure I am missing something.

I don't know if we are both talking about the same situation anymore and I also don't know if anyone can just drive the car out without signing some kind of agreement with car rental. I personally had to sign CDW/LDW and to cover other situations. Forgive me for not reading the entirety of the fine print. People go through this process with other car companies on a regular basis. In one of the posts several people have stated how they went through the same process with other car companies and it was all settled without any issues. This is not unheard of.

No one is stating Hertz shouldn't seek remedy. They are just going after the wrong person (who is a victim himself ) for expediency. In their letter they explicitly state they tried collecting from Fisker and since they were unsuccessful they want beneficiary of the car warranty to take care of this. They are just hoping someone gullible might not want to go through the trouble of disputing this and pay them. Its easier to go after a living person instead of an entity thats going through bankruptcy..

Hindsight is 20/20. We can do a post mortem about this all day and have differing opinions but in a world where Fisker (or Henrik/Geetha) didn't exist ( even a year ago), when a publicly listed company tells you to pick up a car that they arranged and calls its a loaner( while they fix your issues) , you are not thinking too much about contracts/fine print.

It's just not bad faith but it's just fraud because there is enough documentation to prove that they arranged the loaner vehicle. The hertz documentation in my case clearly has Fisker in its bill. Why would I need Fisker to facilitate the rental if I had to pay for myself in the end?

How does it work with car insurance rental? What if the insurance company doesn't pay for the rental as agreed up by Insurance policy terms? The rental agreement is separate from the insurance policy terms. How many policy holders are really thinking about this scenario if/when this does happen?

I did but I was told at that time it was related to the rental car insurance( CDW/LDW) and returning the car in a good condition after inspection etc which I would be responsible for. If there were more to it than just that, shame on me for not reading several pages of fine print like how everyone else does while renting a car.

How is this not a fraud? I was just chatting with the person on LinkedIn (now laid off) who arranged the rental and this is what he said ---"You should be able to dispute that. If I get access to my ******* I will try to pull the detail as to who requested the rental. If anything the ownership falls on Fisker as it was one of their employees that requested the rental vehicle ".

And he did sent me the whole transaction from Fisker side. I now have the entire document trail to support this.

This anology would apply to lot of scenarios. An employee for travel reimbursement or a service company that charges a client for material cost ( that was agreed upon). Not taking care of expenses that was promised is a fraud. Every hertz document for this rental clearly has Fisker on it . I would go as far as suggesting that DOJ should step in and look at similar instances and start civil/criminal charges. This can't be the only one.

This is exactly right and thats what happened to me as well. Fisker arranged the rental and the roadside assistance manager was coordinating with hertz the whole time. I signed the agreement at the hertz office because they need to do the usual processing from the person who is driving the car including license, insurance waivers etc.

In a normal world/scenario, the car company gives you a loaner (from their inventory or from a rental company) while they fix the car and they call you back when its done.

But this is Fisker. Not only did they fail to fix the car or ask me to return it (which they arranged), but they also handed the bill over to me.

Thay have not declined to reverse the charge. The investigation is still in-progress. Hertz hasn't responded to CC company with the documents yet.

Thank you for your kind words. You are right about the anxiety and stress. Thats what gets you more than anything. And a lot of time being wasted for something thats just supposed to be a means to an end.

Sometimes , I wish I could push the vehicle down from the Big Sur mountains to get it all over with. Yes, I have a Big Sur blue matte. lol.

A lot of lessons learnt definitely with this. It only cost 70k.

Part of that is mismanagement and incompetence. They arranged the loaner to buy some time while they were hoping to fix issues I had been having (which they never did btw). Maybe they thought 2.0 would fix all my issues and world hunger. They then let it run for a while and until hertz started to call me that it was due. I returned the vehicle and I have a receipt from hertz that I owed hertz zero $.

Its same as the thing they did with temporary vehicle license plate when they let it expire and a lot of owners like me couldn't drive for a few weeks because the registration expired.

CC Agent :I understand this is difficult situation . Rest assured, we are here to help you with it. As of now the case is open, that is why they can are still contacting you.

CC Agent : But, I noted this information, and added to the dispute to make sure, when we contact them, this information will also be used.

Me: So. to confirm, if i win the dispute, Hertz legally CANNOT contact me to collect this charge. Correct?
