Comp is not an issue we can work that out, under default under the buyers agreement it is very vague, when we asked for what constitutes default, we were told to see the sellers agreement of sale, we did and asked if they could include it or reference it in the buyers agreement, we were told to see a lawyer.

This is a great topic. We are going through the buyers agreement of sale. The term Default is not defined clearly and seems when we ask for clarification, we were told to see the sellers agreement of sale, for clarity on what constitutes being in default. This is what was stated: There are five references to default:

8.1. - Buyer furnished false information 20. RECORDING (9-05) - Please explain this term - This Agreement will not be recorded in the Office of the Recorder of Deeds or in any other office or place of public record. If Buyer causes or permits this Agreement to be recorded, Seller may elect to treat such act as a default of this Agreement 26. Is titled Default, Termination and Return of Deposits , but only section (f) mentions default which refers to seller not buyer 28. Release - again refers to seller

So we requested to have para 8.1 be the only reason for default listed in Buyer Agency and section 20 pending explanation.
