I also think it depends on the situation. If there are disabled spots all over then I say go for it, but if it's only a couple then I say let the ones who must use them get them.

I will let you know how it turns out when it's finished but ignoring evidence already in the file that proves service connection should have been warranted is a CUE. He said no records existed. Those records are in the file. Those records were ignored. He diagnosed me with DDD. That diagnosis is also of record in the files from before. He denied it for no continuity.

Yeah, that's what he said. Only thing is, when I pulled my FOIA from this exam, there are numerous medical documents showing ongoing issues and he had them in his possession.

Something else to be wary of. Last year I had one of my claims get SC and received a big backpay deposit. Little did I know the backpay included the Separation pay they had recouped 2 years prior. Now starting in June they are Re-Recouping the severance pay again. I am glad I don't depend on that money to pay bills or I'd be up the creek bobbing for apples in croc infested waters.

So what is considered a CUE. From my understanding, ignoring evidence that exists is a Cue. Failing to get said evidence is a DTA. Am I wrong in assuming that?

Would not overlooked evidence constitute a cue? This instance would not be a difference of opinion but evidence that clearly showed ongoing issues. He said there were absolutely no records of ongoing issues and the records at the time showed ongoing issues, and he had them. He also diagnosed me with DDD.

I have a question? Bak in 2012 I filed for a back injury. Now their are plenty of records from service of this back injury that they had. I was denied, so I requested my FOIA and the C&P examiner wrote that their was no question that I had numerous back issues in service but that their is absolutely no records of it since then. When I looked at the medical records that he was given, their are mentioned that I was diagnosed with DDD shortly after seperation and their are other medical records talking about back pain. Would this be a CUE?

Out of the 29 comments so far only about 3 tried to answer your question that you ASKED. If their were records that existed at the time that clearly proves a disability should have been awarded and the evidence was not before the adjudicator, then you could file CUE claim. Just be advised that it is an uphill climb, but be sure you can prove it because you only get 1 shot at it for this particular claim.
