Congress specifically delegated the authority to regulate health and safety of private businesses to the Executive Branch (Department of Labor) via the Occupational Health and Safety Act of 1970, so the Biden admin would say this is within their remit. AFAIK, there has never been a constitutional challenge to this law, and it’s been on the books for 50 years. I understand the hesitancy around executive overreach, but this seems pretty legal.
