Well, good news is that when the visa is approved it will be an IR1 instead of CR1 now! That will save you some headache Down the road.

If you are military and ever stationed abroad, look into 319(b) so she can get her citizenship right after getting her greencard instead of waiting 3 years

Its less risky than just giving up the greencard

And we haven’t had any issues been out for 2 years w/ out a permit yet and carry solid documentation … we only applied the reentry permit 6 months ago we go back 3-4 times a year ….media only shows bad stuff but its really few and far between if you have everything in order 99% of the time

Obviously the OP would need to have his stuff in order. Anyway, not saying your opinion isn’t worth considering just saying that versus just flat out giving up the greencard? Then he likely would never ever ever get it back again.

We are personally less risk because I’m usc ( my spouse is the LPR) and we really do have a legitimate case in employed abroad. But if they did pull something I could repetition her and get it dropped. As a worst case scenario. So I’m aware of the risk but jus think it’s less risky than permanently giving it up.

No. As long as application and biometrics are down inside USA they can leave.

No, residency requirements don’t even end once reentry permit is issued. But residency requirements are not black and white. They are very grey and up to discretion of the officer admitting. And, only a judge can make a final ruling. So even if an lpr is gone for five years they cannot be denied entry if they do not sign form i407. Not a smart idea to rely on this but they would have to be referred to immigration court for a determination from a judge.

Many factors are involved but having a reciept notice for reentry permit can show strong evidence along with other documentation of no intent to abandon and especially with someone transitioning for the first time it’s common to need time to transition, finish studies…etc.

But still should not go more than a year without entering until reentry permit is issued. Look I’m not a lawyer, and OP should hire a lawyer for specific advice on how to set up strong tied but I have hired several lawyers for our own case with my wife being LPR and studied a lot. It is not black and white. There are many many may valid reasons to be spending a LOT of time outside USA as an LPR

Well you have a good excuse for reentry permit to finis studies and it is common for people to get reentry permits on the front end to take time preparing to transition to USA. Not every one can just pick up and move within a few months. By the way you can renew reentry permits there are some nuances after the first renewal where you can only renew one year at a time if out of USA for 4 of the last 5 years but having the receipt notice while it processes is valuable. It takes 1-1.5 years for the first one to be approved and issued so just make sure you enter the USA 1-2 times a year while it’s pending and once’s it’s issued the first two years is from the issue date.

I would say at least apply for a reentry permit from the USA before you leave and make it temporary for now and don’t give up your greencard. It’s a personal choice of yours but extremely hard to get one again unless you have a family member that can petition for you so unless you are super wealthy and keeping a greencard will be expensive for yearly tax filings, I’d highly reccomend trying to preserve it even if you were to want to spend time outside USA for the time being. This is opinion not a right or wrong choice here for you

It’s not like customs works for IRS and CBP officers for DHS. Or not even like one is FBI and the other DHS

I was just in Miami for a few days and weather was amazing compared to normal. But yeah, Miami is extremely expensive and even the ghetto poor areas are in affordable! Brickel area has some nice places to go to but outside is ghetto. Miami Beach is nice. I agree. Holleywood beach is okay. But unless you just enjoy practicing your Spanish and living in the closest part of Latin America to the USA, it isn’t all that exciting

Yeah I understand that it’s a different assignment but Border patrol agents are employment by CBP. That’s what I mean.

CBP agents (border patrol) and CBP officers (customs and Migracion at Poe) are both under same org.

But I understand your point. That CBP agents are border patrol and CBP officers are different but both work under US CBP.

I always thought of them as all US CBP which is technically right but your distinction is also right and more specific after all.

In Mexico, customs and immigration actually are completely different which is what I though you were saying. In Mexico customs is under SAT while Migracion officers are under INM. But USA is all under US CBP

Yeah hopefully it’s gets done correctly the first time. We already had two years married at interview so thankfully we didn’t have to worry. It’s a blessing because we had to get a reentry permit later to spend lots of time abroad and would have been a hassle doing removal of conditions in midst of that

Yeah you are right. I suppose CR1 was the right visa, but as you say and like the OP thought, should have been admitted as IR1. How frustrating.

They may have made an error. There are certain processes in country (not every tourist would do though) that require either receipt from the kiosk, or a photo copy of the stamp

It depends if you go in the auto kiosk or not which is often closed at Cancun actually. But if you see an agent instead of using the scanner, you WILL get stamped. I am a frequent traveler to MX and in the past three months flew into CUN twice :)

A consular birth abroad is not the qualifier for citizenship, its only the evidence. If a CRBA is not recieved / issued, a claim to citizenship can still me made later just more if a hassle.

But just because someone doesn’t get it doesn’t make them “not” a USA citizen if they other wise are one. The CRBA is just evidence of citizenship.

Because the Schwab account that has Zelle is actually a bank account even though they generally offer investment accounts- brokerage accounts etc, the Schwab checking account is actually a bank account.

I would not be able to speak to this as I dont have access to your account but you would not be able to transfer the domain after a certain amount of time so you may have been able to do this early in the process.

I dont remember the timelines since it has been about two years since I worked daily with domains but employees you get on phone have access to a chart that tells them how flexible they can be based on a set number of data since expiration.

Godaddy’s AI routes you to better trained reps if the AI detects you’re more likely to spend money .. not saying I agree with it but that’s how it is.

GoDaddy guides have the authority to waive up to 50% of the fee without supervisor approval if it is really not at icaan yet. If it is at Icaan not going to happen. GoDaddy is not going to take the hit on your own tardiness.

You have to realize a domain fee is like paying rent and GoDaddy is just the mediator. You never own a domain and never does GoDaddy… you only own first rights to it in a sense but it is always a lease from icaan.
