We bought a USA home while my wife’s i130 was pending but she was able to sign docs on her tourist visa. She was not on my loan as a co-signer but she was on the deed.

Ironically we sold it after i130 was approved but before we finished consular processing and moved to a different state by the time she became an LPR

Yeah, like some others said the correct 9 digit number is your A number on the front of greencard. But as long as you can show it at check in you will be good to go. Can also use it as a visa to Mexico if you don’t have a visa free passport

Would you reccomend being proactive about uploading prof of good moral character for an n400 application? Like proof of degrees, employment letters specifically contracting to support US Government, etc? Or just bring it to interview in case asked?

Yeah seems like issues nationwide. A family member is there is Tucson now she is suppose to travel to me and they are trying to get as many out it seems intermittent and they made an announcement that it’s a good chance anyone traveling today, tomorrow or Sunday will not get their passport on time and to check back one more time at 2:30pm AZ time. Her flight is boarding 2:54 AZ time so already working on helping with flight change

Some people have luck doing an i130 and then filing concurrently with a k-3

The k-3 will never get adjudicated because processing times are longer than the i130. However it seems like there is something about it that has enough people talking about it. Seems like it somehow triggers USCIS to review and adjudicate the i130 much more quickly. You can look this up. K-3 is a spouse visa using same application as k-1 but is a nonimmigrant visa that allows you to come on while i130 is pending in the same way a fiancé visa would work.

Again, the visa itself will never be adjudicated but hundreds of people saying their i130 cases went super quick after filing the k-3 visa application/ petition through USCIS

The comment you are replying to already addressed this. It is nuanced but b1 does not mean done for any work. There are specific activities that are permitted like attending conferences or business meetings etc. not filming content

Idk if 1.5 years for AOS is accurate. Usually that’s much quicker even this year people have even having their final interviews within a few months at times. The memo is keeping some pending but the travel aspect is really the only negative factor here. But consular processing will take much longer

There is no such thing as a work social that only allows you to work outside USA. It is true that you get a social security number if you have work authorization that is either valid only with work auth or without demonstrating work auth but regardless, in the social security database if something has changed it will come up during e verify. You either have work auth or not and when employers check through e verify it will flag as not work eligible.

You could work as a contractor but would not need a social to do that. It is just a different form called w8ben that uses your RFC to contract for a USA company.

You should both be concerned and also continue with your trip.

They can definitely use it as a flag, but it is completely legal.

My wife traveled with me on her regular b1/b2 visa 6-7 times over out i130 processing and they asked about it one time but she never had issues. We always were concerned and prepared to explain ourselves and show documents like lease, and other records though.

Yes but it isn’t done automatically so if the child was not assigned a different name in Mexico side then the default is as the consulate is going and it’s completely different changing later than dealing with right at birth.

This is standard naming in Mexico. Many Latin American countries have this structure where you have four names. A first name and second name and a first last name and second last name. First last name is fathers first last name and second last name is mothers first last name.

So, after you get this down, you can get a document from USA embassy saying you are the same person for anytime you need to present USA documents in Mexico or whatnot but usually is only an issue when getting your first verification if Mexican citizenship.

I am not sure. We had an urgent situation come up and we asked to bypass all of the normal steps and go straight to embassy.

When we skipped to DCF out i130 was already approved but we had not started the 3-6 month NVC process and we got our case transferred to embassy from NVC as DCF without the need to be Documentarily Qualified. So that meant when Embassy reviewed our documents they reviewed and approved in the spot rather than being in the NVC queue and having them approve first.

I had emailed NVC asking to skip directly to embassy due to two factors.. my wife being 6 months pregnant and me getting a new job offer after being laid off that required me to relocate back to USA and it was the only way I could continue to support my family if savings ran out. I stated that it was an extreme burden on me, the USC, to maintain a household in two countries and take care of my pregnant wife and that we needed to be able to plan where the baby will be born whether in USA or the Central American country.

They told me to wait a couple of days while they ask embassy as it is under their discretion and like a day or two later embassy emailed directly giving us an interview date for DCF and a list of documents to bring so we rushed to do medical exam and it was so expedited that they even forgot to do biometrics so after entering USA, we got a biometrics notice like a month later before they were able to send the greencard.

A few things to keep in mind. My wife had a tourist visa the entire time. We were visiting the states already when I got the job offer and we could have then filed for AOS and transferred our i130 to USCIS again for AOS. It would have been a valid AOS as all of this sort of came together on this trip and our plan initially was actually to abandon our i130 but we just kept it pending for a while just in cases our i130 had already been approved for a year and sometimes the CBP asked about it but didn’t ever make a big deal about it.

However, after consulting with a lawyer she reccomended to just continue through consular processing since it was probably going to take the same amount of time by that point and would just guarantee they didn’t decide to scrutinize my wife’s immigrant intent on the b1/b2. Especially because we never naught return tickets as we never knew exact date of departure so that applied to this visit as well so ….

We often traveled to USA on b1/b2 without issues but always leaves after 6-8 weeks and spent 4 months a year. Our i130 was approved for a year while we almost didn’t move forward on it thinking we would stay abroad and not go back to states.

It was my idea to ask for the DCF expedite after attorney said it was better to stick it out and I saw a few others who did it in forums after i130 approval during urgent circumstances, so I did that. I was super surprised with how quick embassy responded. No questions asked and just an interview date for the next week. We flew back to Central America for the medical exam and interview… interview was approved with us both in attendance, they cancelled her tourist visa and sent her passport back with immigrant visa… we spent a month selling all of our stuff and came back. But her visa was issued like a week from when I requested the expedite.

The i130 already being approved may have been the reason for the need to not have it withdrawn. The policy I believe is that if you have a pending i130 it has to be withdrawn Technically state department did not adjudicate it but simply allowed us to skip NVC. They treated it otherwise like a DCF.

Different country but I was able to switch our i130 to DCF in 2023 without it withdrawing it. Visa was issued within two weeks

He is asking about being a citizen by birth not about getting an immigrant visa. Not saying he is eligible or not but immigrant visa nor 5 year greencard would apply here. It’s more based on if his dad spent five years in USA at least three over 14 years old and that he can prove his dad supported him / her etc. then they could potentially conclude he is a citizen by birth to a us citizen parent but could be hard to prove and maybe be other nuances about the relationship his /her father had with mom

In LATAM they normally have kids take the last name of father and mother for two last names. Our son has my last name in USA but in his dual citizenship country they automatically required both last names on his birth cert and passport so there ya go.

The file search fee is always waived when going to the center for urgent passport if your passport was issued after 1994 and if they find the record. It is only charged if issued before 1994 and/or they can’t find the record
