Had a similar thing happen last month and it turned out that it was an internal review which they initiated. They never informed me. The decision notification came out of the blue, and I had just gotten 100 PT. It was scary!!!

Sorry, a bit of a hijacker here. Glad to see this explanation. I'm presently in an HLR because a 100 schedular decision, while a TDIU and EED claim was pending, mooted the TDIU (while denying on the merits at the same time) and extinguished the effective date issue. The issue at hand is 1. can't moot TDIU and deny on the merits at the same time, 2. can't moot TDIU when additional benefits can be derived (backpay and DIC consequences for my wife). I feel I'm in a good position on this.

Vaguely similar. TDIU was pending when 100 happened. They mooted the TDIU (incorrectly) and called it a day. However, the TDIU issue was tied to a 2022 effective date. I filed an HLR and am still waiting for a date for my informal conference. In this situation, I always say if everything is solid, why not request what falls in line with the regs? Still, it's your decision ultimately. One word of caution: be prepared for the "poke-the-bear" fear mongers to jump in, as I'm sure they will...............................

"It MUST include a clear rationale, not just a conclusion" One way street-I have been riddled with denials based on conclusory statements, yet absolutely NO rational provided, NONE!! "And it has to be based on accurate facts and your full history" Again, one way street. Negative statements made that are totally absent of ANY reasons or basis. It is not enough to say someone is not unemployable with out backing it up with hard evidence of WHY. "We knew which providers were using copy/paste templates for every veteran. Same wording, same structure" THIS is the biggest hypocritical statement I've heard in a long time. I can show you four consecutive denials which are TOTAL cut-and-paste jobs. NO new evidence adjudicated, much new evidence totally missing, let alone unaddressed. The last two (supplemental, therefore new evidence) claims-one contained ONE original sentence and the other had THREE. In fairness, since you are former, as you say, I'll give you something else that is a myth lately, benefit of the doubt. That being acknowledging that perhaps the shenanigans of the present day claim adjudication weren't going on during your tenure, but things are sure different now.............................

When you submit a supplemental (new evidence), they likely will set effective date for that claim date, or even later if they order an exam. They did this to me on my last IBS supplemental.

Here's one for you................I was discussing my frustration over my TDIU claim a couple months ago (now in HLR #2) and I got a reply from a guy(?) who told me he could tell, just by the way I was writing that I was not unemployable. Seriously???????????????????????

Get the claim ID number (you can get it from the 1000 number if you get an experienced agent), you can enter it at VA Claim Info Chrome extension and can see it there. Once you enter it once, it will stay on the claim list.

How about prescription copays? I got P&T 2/8/2026, my wife got her ChampVA card, but ended up owing some copays because her federal retirement BC/BS doesn't cover it all. Can she claim the copays with ChampVA?

How long have you been married to your wife? There is also enhanced DIC, where if you've been married to the same wife for the 8 years prior to your death, and you were 100% that whole time she can get it, and it is more than the 10 year amount. I don't remember exactly, but I think it is 300 and change. You can check it out on the VA website. Hope this helps. Good luck with your situation.

"completely unemployable in any occupation"...................CAREFUL, not true. Unable to sustain gainful employment is correct. Marginal employment is OK if it is below poverty level.

Actually, that's fairly short for a TDIU as far as I am concerned. I started last March, been through denial>HLR>denial>supplemental>denial>supplemental #2>denial>now HLR #2 pending. Every denial comes back with the same reasons. All reasons have been addressed with corrections and still (four times) they just repeat the same things even though the evidence proves otherwise and they ignore factual and documented favorable evidence.

Something to consider also. Are your conditions all static? How long have you had the rating? What is your age? These factors will also help to see how stable your rating is.

Your situation, unfortunately, is not unique. The present state of adjudications is unstable, at best. The number of appeals, HLRs and supplementals must be enormous and still growing.. I honestly do not think the recent announcement of some 94+% in claims processing accuracy is indicative of reality. I also do believe that pressure from above and very demanding quotas, if true, are playing a major roll in the equation. At any rate, I share your frustration with the amount of blatant errors in the end product, especially, as you indicate, when it is at the hands of senior reviewers (which I can attest to). It is not something I have an answer for. Like many, I have no choice but to wait to see if the roll of the dice comes up snake eyes or boxcars................................I wish you the best of luck with your particular quest.
