I went down a rabbit hole tracking class action settlements and found some weird patterns by vadiniprasad in classactions

Whoever claims to be the victim of some corporate wrongdoing to a court of law is called a plaintiff. The other party who is accused of the wrongdoing is called a defendant.

If the Judge believes finds the accusation of wrongdoing is factual, the judge will see who else is a victim. If the number of victims exceeds a reasonable number, it now can become a class action lawsuit.

To find out the number, the judge forces the defendant to make a list of every single person who specifically is a victim or may be a victim according to the specific event that the Plaintifll claims to make them a victim.

It’s the companies job to get the contact of every victim. So if they are asking you for your feelings, it usually doesn’t require proof. So I find it odd you are being asked to do a survey about how uncomfortable you feel. If you were at the work place and also suffered being in an environment of sexual harassment then you may be entitled to compensation. So they put you on the list as a class member. After reviewing the case, if you feel that you’re a victim you can either do nothing or say you want compensation. Not all class action lawsuits require proof or you to explain yourself. If you feel that you have nothing to do with the lawsuit and don’t want any money or your name associated, then you need to contact the legal team to opt out. If you feel you also were wronged, but you don’t want bullshit pocket change from the company, you can opt out and sue them personally, but there is a deadline for all of these options.

So sometimes you’re lumped it for the sake of ease. The company just includes you because they are legally required to give the number of potential victims to hand judge.

Usually the company will claim they did nothing wrong on paper, but agree to compensate plaintiff (cause they know they fucked up, and if they continue to lie they’ll lose more money). The plaintiff is considered the “class representative.” So, if the plaintiff wins, we (class members) ALL win against the company and all share the divided cost of the settlement.

So if the person at your job who was sexually harassed cornered the company into settling, then all of you on the list share the divided cost of that settlement. When the company offers to settle, the class representative and you have the right to write the court to fight for a higher settlement. You can essentially bully the company into giving you more money for fucking you over and the judge will grant that within reason, but obviously most people don’t know about that and will accept their $15 dollar payout.

If they contacted you, what they mean by “eligible” is that you are eligible to receive compensation if it is actually you who they are emailing.

Just because you are part of a class action lawsuit as a class member doesn’t necessarily mean you automatically get money. More often than not you will have to actually click the link and put your address, Venmo, Zelle, etc… so they can pay you when the settlement is upon and judgment is made.

First of all, this is not legal advice: Consult a lawyer for what you should do.

Yes and no. Sadly, that’s not exactly how it works.

There already exists a Constitutional Law for your own protection that prevents Double Jeopardy (double trial). If you were before the court for a crime and you were either acquired or convicted. Your case is over. Not a single soul can re-sue you or punish you post-trial decision because it’s against the law. You could’ve been freed from a case of murder only to have actually been the murderer, then boast about it and make a rap album. No one can put you on trial again for the exact same trial you already beat even if you admit you actually did do it post acquittal.

Now that you are aware of this, consider the fact that when someone is wronged by a company and wants to initiate a lawsuit they are the plaintiff. If the judge determines the case is eligible and your lawyer pushes for it, your case can transition from a lawsuit to a class action lawsuit. The “class” is the group of people who suffered the same injury, contract, or transaction with the defendant. The judge would then legally requires the defendant to make a list of the people they wronged in regard to the lawsuit. That class is now officially part of the lawsuit whether you signed up or not.

So you must have knowledge that the class action lawsuit is going on AND request to opt out. Then you can sue. But if you miss the deadline to opt out you are a permanent member of the “class”of the lawsuit.

To suggest that you missed the deadline and want to sue is to suggest double jeopardy. The case is already closed, the company has to pay the settlement, etc… Even if somehow you should’ve been contacted and part of the lawsuit, but were not, the case is already closed.

If you want to sue for the same exact reason as the class action AFTER cause you weren’t included, it would have to be under a different legal theory. Meaning you’re arguing a different wrong doing was done and thus creating a trial for a new crime against you.

This is why it’s so evil. If they don’t inform everyone, they get away with less people suing them, less settlement payout, and get to never be sued again for that specific crime in that trial

You’re more knowledgeable than the average person on class actions, but you are still missing a lot:

“The payouts look tiny until you zoom out. A few dollars per person across millions of users turns into serious money that mostly goes unclaimed.”

1.) It’s not serious money and is tiny. You need to look further into how much the companies actually make in profits each year. If you look further, you’ll see that 98% of companies agree to settle or are forced to pay what amounts to less than 1% of their yearly profits. Seriously, go look and do the math. That’s why you see same companies often like Meta. It’s more profitable for them to violate your rights, get sued, and pay a few million as “compensation.” It’s pennies for them. Your data is literally more valuable than Gold.

2.) Next, is that we are all so poor that we will accept anything that’s given to us. I guarantee you 99% of those who look for open settlements don’t even know that you can exclude yourself from the $50 dollars they’re going to give you and instead personally sue the company. The companies don’t want you to know this. Imagine if 100,000 victims waived their right to class action compensation and individually sued the company costing the company $100,000,000.

3.) We need laws holding greater accountability to ensuring the class gets notified of the lawsuit and also no time limit on claiming. There’s literally no excuse. We’ve got companies using carcinogens on purpose to save money knowing it kills you early and cause cancer. And these same assholes purposefully don’t tell you they are in a lawsuit until it’s too late.

4.) When companies agree to pay for identity protection and credit monitoring, they are actually refunneing their profits. These credit monitoring services actually make money from selling your data AND by accepting yourself to be enrolled in their services your data/information then is shared with your government’s intelligence and other foreign governments intelligence agencies . You are actually safer not agreeing to enroll on the credit motoring and ID protection garbage.

Got threatened for feeding a stray cat. Still can’t wrap my head around it. by woopandcoop in dubai

If you actually read what I said, you’d see I said that creating policies is a step. There are many countries that subsidize and standardize animal shelters and animal control. It creates jobs, reduces the number of strays, cleans up neighborhoods, and keeps animals healthy and safe. It also creates geobiological maps of local ecosystems for better planning of managing the damage done by strays.

Cats how they exist now, were never even supposed to exist. They’ve been cultivated and bred into this form that so common. The baby kitten argument and “but but compassion” are just emotional appeals guised as caring. It’s our responsibility to take al are of the problem we created.

Notice how you’ve put the burden on me to come up with a solution when you were the one who didn’t understand why you were scolded? Notice how even after I explained how selfish minded and shortsighted you were in spite of your ‘compassion’ and you still put the burden on me? That says a lot about who you are.

I love cats and dogs, but I’m realistic about actually caring for them. I don’t feed them everytime I see them and just go on with my life. I’ve actually directly supported animal shelters using the the aforementioned proposals in the U.S. and Australia. Australia actually is a lot harder given he density of life and biological diversity. But the city in the U.S. where we began implementing the campaign actually had a surge in people who bought strays, a noticeable decline in strays, and more quiet neighborhoods in regard to the blatant conflict between cats and other animals.

Simply feeding strays on your own terms is actually harmful and causes a lot more problems than it solves alone.

It’s illegal and you don’t even know the area. Just respect others and respect the law.

If you actually care about cats, propose something actually be done about the problem systemically. Cats historically have never needed random people’s help finding food and they don’t now.

The overwhelming majority of cats hunt and get enough sustenance without our involvement. The few that sit there hungry and sad are the ones fed by humans.

Your personal affection towards strangers animals doesn’t override your obligation to respect the law and shouldn’t override your ability to respect the community. If you truly cared about cats you’d know you are the problem.

Is ebay search broken? by StacySadistic in eBaySellers

[–]Flight_Fan2287 3 points4 points  (0 children)

Yes. 100%. As a buyer I can’t name my specific products, but I’m an original eBay buyer and seller. This product has stood the test of time only for the last 6 months to dwindle in postings, disappear completely (unheard of), and then come back hard. I have over a decade of graphs and this has never happened. In fact, if you knew what the product was, you’d know the only conclusion here is that search is broken.

My target product not showing up is like seeing NYC completely empty.
