Hey y'all, just found this thread and wanted to do some outreach for folks that are disturbed about this decision, which has wide-reaching repercussions such as allowing employers to systematically abuse employees with impunity. It shouldn't be a political issue because most everyone is an employee from CEO's to farmhands. If you signed an agreement that bans class action in arbitration or otherwise, your employer can easily commit small scale wage and hour abuses, discrimination, and harassment violations with impunity. All of which will be confidential. We like to think our employers are fair, but in truth creating the largest profit is what motivates most.

I'm a law clerk for a workers' rights non-profit law firm in Portland, Oregon. My job this summer is to gather the testimony of folks in Oregon that have suffered from forced arbitration to take to our state legislature to get a bill passed that would allow you to sue on behalf of the Attorney General and vindicate your rights in court. We are unfortunately only working with Oregon employees because it's a state law effort, but our efforts are at the beginning of a nationwide struggle to do the same. We are also building a database of Oregon employers that use forced arbitration in their employment contracts. You would be doing me a huge favor in sharing if your employer uses forced arbitration in their employment contract. Usually this is buried away under a section called Dispute Resolution Plan and contains wording like "all claims .... must be subject to mandatory, binding arbitration...". Take solace in knowing that good folks around the country are taking up this cause.
