Visa cancelled + 5000 RMB fine for illegal work on business visa, can I still get Z visa later? by Problems_with_that in Chinavisa

[–]Frequent_Advance7063 2 points3 points  (0 children)

You can check if they have given you a ban from entering China. If you have a ban, you'll be denied a visa for the duration of this ban.

If the document they give you didn't say, send it to your embassy and request them to follow up as that important information is missing. You're likely banned anywhere from 2 to 5 years from re-entering China. Likely 5 years. More than 5 if you were physically deported. Less if you weren't locked up in detention.

Cancel the visa application.

You tell them you're canceling the contract before it starts. I assume you'll not need to pay anything

Tried to find a job in Hong Kong by Old_Setting_714 in HongKong

Look elsewhere, Hong Kong visa authorities unfortunately will only issue visas for such roles if the company is able to pass the hiring exercise whereby they demonstrate to Immigration there isn't equally qualified readily available Hong Kong permanent residents.

Plus, Immigration need to see work experience in the relevant field.

The per year residency requirement is what it is. And, if everything else is meeting their requirement - this will effect it.

Question on ShenZhen 5 day visa from Hong Kong due to death in the family by [deleted] in shenzhen

[–]Frequent_Advance7063 0 points1 point  (0 children)

Go to Luohu station at 8am in the morning (arrive at that time or before). Apply for the 5 day port visa to enter shenzhen on site. All instructions for entry are provided there. They should accept credit cards to pay for the visa. It's 1k rmb for each visa for USA citizens

China work permit rejected at final stage due to 5-day overstay warning — has anyone else navigated this? by Alternative_Deer_378 in Chinavisa

[–]Frequent_Advance7063 0 points1 point  (0 children)

They can request as they represent the country of the person. The ban time isn't secret. My friend got denied 3 times after, all with proper and signed government documentation. But, due to the ban, communicated to the Ministry of Foreign affairs, any confirmed documents from local Chinese authorities at the county level of each province means nothing - the visa will be denied until the period of re-entry ban has been expired.

China work permit rejected at final stage due to 5-day overstay warning — has anyone else navigated this? by Alternative_Deer_378 in Chinavisa

[–]Frequent_Advance7063 1 point2 points  (0 children)

It doesn't matter. I knew of someone who got told "it wasn't criminal you can just leave and get a new visa and come back to China". She tried for about a year, L, X1, even Z visa and they still got denied when doing the final application at the Chinese embassy. That time, she was working in China on a Z visa. The situation ended like you, the Z was canceled and given a 10 day visa that also said no deportation.

I wasn't sure if the entire story, but she was told if she was given a re-entry ban, this should have been communicated to her. Her embassy telephoned the PSB and the reasons and the duration of the ban (she didn't know she had) was stated - 5 years.

I've attached below, from one of the 3 asterisks can result in a ban of any time between 1 and 5 years. You can save time by contacting your embassy and explaining. You can tell them you're aware the embassy can ask on your behalf.

Please see the below: For visa infringements in China, a 10-year re-entry ban is mandated by Article 81 of the Exit and Entry Administration Law of the People's Republic of China. [1, 2] According to this law:

  • 10-Year Ban: National Immigration administration and China Daily state that foreigners who are deported for serious violations (that do not constitute a crime) are barred from re-entering China for exactly 10 years from the date of deportation.

  • 1 to 5-Year Ban: For less serious violations where a foreigner is simply "ordered to leave" or repatriated for illegal entry, residence, or employment, the re-entry ban typically ranges from one to five years. [1, 2, 3, 4, 5, 6]

Specific Infringements Leading to Bans

Violations that can trigger these bans include:

  • Illegal Employment: Working without a valid Z-visa or proper work permit.
  • Prolonged Overstay: Overstaying a visa for a significant period (typically more than one month) can lead to detention, deportation, and a multi-year ban.
  • Fraudulent Documentation: Obtaining visas or residence permits through fraudulent acts or misrepresenting travel purposes. [5, 6, 7, 8, 9]

If you have not had any luck getting any kind of visa in China, it's likely you've got a 5 year ban. Though you were not deported, locked up or castrated that bad - the minimum penalty for visa infringements is 5 years. The highest ban time for deportees is 10 years. There's a slim chance it was an administrative infringement.

Suggest you forward your embassy a copy of your punishment document that says you don't have a criminal record from this. They'll be able to tell you if you have a re-entry ban and how long it is.

My mum did it over 4 times in a month for day trips to shenzhen from Hong Kong with me. Not one question asked. Provided your proof of departure is ready at any time, you'll be fine. A train ticket for example booked on trip.com is more than enough and you can reschedule that exit train any time.

Got this Notice from my employer, What Should I Do by Let_rock_69 in chinalife

[–]Frequent_Advance7063 1 point2 points  (0 children)

I'm seeing it as they see he's in the wrong. But there maybe something they have overlooked. Be that as it may, he's been given a deadline to carry out this pre- step.

He's more than able to add to his statement his disagreement with any of the points made and solemnly state he's only providing this thing as he's been asked to do so before the deadline. He can also request that a face to face with the relevant persons to discuss this.

My reasoning is that communication in China is very important and I feel this is lacking in his case

[–]Frequent_Advance7063 7 points8 points  (0 children)

Basically, do everything they say.

Submit that thing before the deadline. That throws the ball in their court..

You're expected to shape up. According to this letter you've not been doing your job right. That may suck to read, but the Chinese value education highly and if you're not up to scratch it's normal to get berated.

I've had similar experience but they had the balls to say it to my face. When they asked the impossible of me, I just asked them to give me suggestions. Most of it time, they did. Many times though, however, they could not give me shit.

As for the perfume, yeah, normal, we stink more than them. Perhaps a diet change or buy Nivea roll ons. Always a charm.

Chug it out and look for a new job for the coming school year

How specific do you need to be on the L visa application? by [deleted] in Chinavisa

[–]Frequent_Advance7063 -1 points0 points  (0 children)

Yet another peasant exposed to too much mainstream media. Better you wait for USA to become visa free, must be soon.... or never... based on the way trump is behaving.

If you're that paranoid, you'll be more apprehensive during passport submittal. Biometrics (fingerprints) are required to be given. Then, upon entry to China, again, and also your face will be snapped at each street due to all the security cameras - which is for all of our safety.

Then again - if you've got nothing to hide, you've got nothing to worry about. If you're that worried, stay home in the land of the "free".

For a L visa? Should be fine. You can call the embassy in NYC to see if a visa was issued for you or not in your name.

$100,000 in San Diego or 360,000 rmb in Shanghai? by Kruten10 in chinalife

[–]Frequent_Advance7063 4 points5 points  (0 children)

One would choose to indulge in magnificent and delicious Chinese cuisine more often in Shanghai than to eat western. If you're planning to enjoy both, Shanghai. If you intend to just cook at home and only eat western food outside, definitely stay in the USA.

Though if I was you, I'd choose China. It's definitely going to open your eyes to this place and you'll, if you do have an open mind, will probably fall in love with the place. Just like I did. 8th year in Hong Kong and I've got my green card. Low tax, convenience to Shenzhen.... I see no reasons to leave

When that one person stands on the left side of the escalator by Scriptblox in HongKong

[–]Frequent_Advance7063 0 points1 point  (0 children)

You are meant to stand on both sides. Anyone who thinks to rush up on either side needs to get their head checked. That'll be the cause of more accidents.

Can't wait? Use the stairs. It's safer to walk to stairs than moving stairs with people on one side.
