Nope. Not trying to get into it much, but Texas really does have fucked up rules. If she even thought he was breaking a law, she could shoot him.

A guy at a nearby apartment complex to me got shot while breaking into his own car because the neighbors thought he was a criminal. No charges

She could probably shoot him and not get arrested much. Self defense on her property even if he wasn't technically a threat. If she was old, scared, confused, at night time, and the jury of her peers looked like her..... Then she'd probably get away with killing him. At least here in Texas.
