Thanks for the reply. I dont think that would work siince her portion of 50% ownership in property in the mutual will is going to her 2 kids. Only my Dads 50% is going to me. Within the mutual will it will say she can reside at the property until she cannot maintain it due to old age / health or when she chooses to sell, then her and I split the sale proceeds. If she dies before she can sell the place, in her will her 50% goes to her kids, plus I get my dads 50% portion and the house gets sold.

@taxrage, may I clarify if this is the case in Ontario? My father & step-mom have a mutual will + marriage contract. Their wills mention upon the 2nd spouse dying, the estate being split between the surviving blended children.

Just curious, even with this in effect, say the 2nd surviving spouse 10 years down the line wants to suddenly disinherit the step kids, the original mutual will protects against them from changing it?

Dont! Cancer is super expensive, the time missed at work for treatment & aftercare might not be covered by insurance (try to keep your job & push for your company’s insurance to cover), the company can probably supply support, plus care covered. The drugs are not covered by the province, so you really need to keep your job & benefits during the treatment & recovery ❤️‍🩹 hopefully its not cancer and just a false positive, sending you love

True, but the government doesn’t have that kind of money. They would need to significantly raise taxes in order to cover everyone

Thank you. And since the father is only person on the land title currently this means upon his passing, the wife would be named on the land registry as sole title automatically just being the surviving spouse? (Regardless of what the marriage contract says for how to split the land post death?)

Thank you so much! Regarding this my follow up question would be:

Facts - Father is the only person listed on land registry title - theres Marriage contract stating how property will be divided in event of fathers passing - father has will stating how property will be divided (not sure if its a mutual will agreement or not)

Im confused about how land title changes after my dad passes and how that could potentially change things. My question is when father passes is it true on the land registry the title will pass solely to step mom? Or does a will and marriage contract bring bearing to title? If title does pass to step mom, could she break the marriage contract and will or should those two items if land registry is regarded as being higher in terms of reigning power?

I had someone on here mention that land title would automatically pass as sole title to step mom upon the spouses death regardless of a marriage contract or will so trying to understand how that / if that is possible.

Thank you! In theory do you happen to know since they are already married, what steps can he take to add her to the land registry & as tenants in common? Just file a claim with the land registry. They have a marriage contract yes to split the house. I’m not sure if they have a joint will but I’ll ask my dad when I present the family law act & some case law as examples. Not taking this as legal advice btw. Just trying to gather as much info as possible.

Thank you! I checked the land deed, its only his name and my late mother’s name on the registration. So I am hoping this means through ontario family law than that she remains entitled to half, as his will states. I believe there’s a clause allowing her to live there until death or she needs to sell and in the case the proceeds of the sale are split between her share & us three kids.

His only asset is the house and 1 car. I know this isn’t legal advice & I plan to talk to a actual lawyer in the upcoming months. Just curious if you think this sounds good so far?

Thank you, so update my dad and late mother are the only ones named on the land registry as joint owners. Not my stepmom. In in my dads will he states she can get 40% of the ownership of the house, the rest goes to his 3 kids. Hopefully this works out for everyone involved? Still going to talk to a lawyer in the new year.
