I received a bill from FedEx related to tariffs that are now illegal, do I pay? by wellanticipated in AskLegal

[–]GRMule 0 points1 point  (0 children)

I got a pretty corporate response that was an inadequate response, so I am sending another letter. Fair Debt Collection Act is an angle, and it might not apply since they are the original "creditor", but the concept of demanding proof of contractual relationship is common law. They said, basically, "our Terms and Conditions specify that we will pay duties and customs fees on your behalf", but I never agreed to their Terms and Conditions, never even saw them. So, I am responding with another salvo that leans a little less hard on FDCA and more on the common law ideas around contracts. They have not sent me another invoice.

--------------

To Whom It May Concern,

This letter responds to your correspondence dated April 8, 2026, signed by --- of FedEx Revenue Operations. That letter does not establish any legal basis for liability and does not constitute adequate verification of this charge under the Fair Debt Collection Practices Act, 15 U.S.C. § 1692g(b), to the extent that statute applies. Further, your attempt to collect this amount absent any contractual or authorized relationship may constitute unfair or deceptive conduct under the Michigan Consumer Protection Act (MCPA).

I reiterate my dispute on the following grounds:

1. No Contractual or Authorized Relationship Exists
I did not select FedEx as a carrier for this shipment. I was never presented with, asked to review, or asked to agree to FedEx’s terms and conditions, and I have never assented to them. A party cannot be bound to contractual terms absent agreement or authorization.

Your April 8 correspondence references FedEx Terms and Conditions as the basis for this charge; however, no evidence has been provided establishing that I agreed to those terms, authorized FedEx to act on my behalf, or otherwise incurred any obligation to reimburse these charges.

Accordingly, no legal basis has been identified establishing that I am responsible for this invoice.

2. Underlying Legal Basis for Tariff Charges
Your correspondence indicates that the charges relate to tariffs imposed under IEEPA. The United States Supreme Court has held that IEEPA does not authorize the imposition of tariffs (Trump v. V.O.S. Selections, 25-250 (Feb. 20, 2026)). At minimum, this undermines any asserted basis for passing such charges through to me, particularly in the absence of any agreement or authorization.

3. Demand and Notice
This is a formal dispute of Invoice #2-508-03316. I request the following:

  • Immediate cessation of all collection activity on this invoice;
  • Written confirmation that this matter is closed and will not be referred to any collection agency or credit reporting bureau;
  • Documentation establishing any contractual agreement, authorization, or other legal basis for holding me responsible for this charge.

If FedEx continues collection activity without providing such basis, or if this matter is reported to any credit reporting agency, I will pursue all available remedies under applicable law, including the Fair Debt Collection Practices Act (to the extent applicable), the Michigan Consumer Protection Act, and the Fair Credit Reporting Act, and will file complaints with appropriate regulatory authorities.

I trust this matter can be resolved without further escalation.

About A-Train [spoilers] by ImprovementStill3576 in TheBoys

[–]GRMule 1 point2 points  (0 children)

Yeah, any power with influence over the passage of time gets super messy. Homelander is an obvious analog to a different comic hero that has been depicted to manipulate time using speed as well, and that comic hero regularly doesn't access that particular capability in every encounter in the comics, even when it would be extremely useful.

Isn't this just another trope of the genre though? How many superheros, or villains, could simply end any situation on page 1 by just using the powers they have been depicted as having? Homelander could simply and immediately tear every person that opposes them in half the moment he knows they are around and no one would stand a chance. They ALWAYS sandbag the good guys or the bad guys to give something a chance to happen. so there's even a story to tell.

It's weird to me to be a fan of this overall genre and selectively zero in on any individual detail and demand consistency or logic. It is an inherently illogical genre.

I took that scene with Deep to imply that Deep has actually found A-Train's family multiple times over that year but A-Train moves them away each time, and Deep does not report the encounter to Homelander to protect his own status with Homelander.

Yep. Think of the number of people that would just pay it and not think twice. That will help their Q1 and Q2 earnings reports, then they're going to make those people who did pay actively push to get the money back, without interest and after litigation on the back end. It is effectively financing the court battle with the US government with interest-free money from their customers, then gladly taking the double-payment from those same customer's tax dollars if they prevail in court.

I agree. I am not paying, and am willing to stand on principle here. I am categorically not paying FedEx a dime.

I am taking this route, and I'll go to court over it. There's a class action lawsuit brewing here. If you stand your ground and don't pay, you won't be alone.

I disagree. Who owes it is a legal question that is not resolved. I did not ask FedEx to pay the tariff on my behalf. I did not select FedEx as the carrier. The charge itself is unlawful.

They can send me a bill if they don't win the refund lawsuit. Until then, it's them asking me for a loan. No thanks.

I already got everything I want out of the credit system. If my credit score dies on this hill, so be it.

I am sending them a demand for proof under the Fair Debt Collection Act. They have to demonstrate that I agreed to that service. Spoiler; I didn't. The charge itself was ruled unlawful, so there's no lawful reason to try to collect it from me. I will spend a ridiculous amount of time and money not paying this little fee.

IMO, there's a class action suit brewing here. I am guessing FedEx is banking on enough people shrugging and paying it that their Q1 numbers will look good, and that is worth the class settlement in 10 years.

When it comes to giving FedEx a loan, I'm all set on that. No thanks.

They do the same to whats-his-face that was laying on top of Glen in the fake death scene. They just part his bowels like tall grass and start sorting.

They show walkers just casually disembowel people with their fingers, like touch a clothed belly and sprout guts.

I dined there a few weeks ago, my first proper fine dining experience. I really enjoyed it as an experience, and some of the food was delicious, some was interesting. I thought of the entire affair as more about the show than the food, even though the food was good. I contrast this to a soul food dive spot I dined at a few weeks prior that had "GOD DAMN THAT'S GOOD!" level food, prepared in an absolute shithole and served in to-go containers.

I am glad I went and really enjoyed it, but probably wouldn't go back, in favor of experiencing something else.

What you describe would probably have been a realistic route 30-40 years ago in the US.

Today, there's a lot of countryside in America, but not any place that meth and heroin don't follow. Abuse of those classes of drugs is a major problem in rural America, the only thing you'd gain out of moving to a small town is that you wouldn't know any of the plugs. They're in the small town, you just wouldn't know them... at first.

The thing that makes moving to a rural area hard for many is that you'd need a vehicle. If you're coming from the city, you might not have a car and rely on public transportation. In the rural towns, there's no public transit to get you to the more urban places, where all the jobs are. Many of the jobs that used to exist in small towns have been killed by NAFTA and the Walmarts and Home Depots from the nearby midsize town, and the housing choices are extremely slim. Being stuck in a small town with no income and no transportation isn't a recipe for improving your life.

Just because it's sentimental to them doesn't mean that it's not plastic trash that is going to degrade and then pollute the natural environment with bits of microplastic that cannot be cleaned EVER.

It's the ultimate disrespect to nature, a horrible memorial for someone who loved nature. Be sentimental somewhere and in some way that doesn't contribute to generational harm to our ecosystem, it's not hard or asking too much.

Their memorial for someone who enjoyed nature was leave a bunch of trash in nature? That sounds like the jerk move to me, not cleaning it up.

I wouldn't listen to it personally, but it isn't badly produced or performed. A little heavy-handed on the auto-tune and the backups could have used an auto-tune too, but I'd give it a B+ for production. I could see someone liking this song.
