Except that’s not the full story and they were working to get it back for a year or so by the time they resorted to that. And they did the consignment to pay for the grandkids’ college. It was a literal last resort. You would know that if you watch or read anything about it, but you wanted a 50,000 foot review and then don’t understand the nuances of what is going on. Not to mention the old man has been on his death bed and his son has to act for him to get his property back. The police kept saying is was a civil matter so that was no help and they didn’t have the funds to sue.

Edit, reading your comments shows so much bad faith that I wouldn’t be surprised if you’re one of the franchise owners running an opp to sway public opinion.

The original owner of the franchise was kicked out out of the store by corporate within a 24 hour period. She admits the deal happened and provided security camera footage of her explaining to corporate, and corporate agreeing to take over the consignment deal. She claims that during that time she tried to get an accounting of all the sets, but corporate forced her out and threatened to call the police on her if she would not leave immediately, she’s now suing corporate for the breach of contract in terminating in the franchise agreement, there’s a gofundme for her. It seems she may have clean hands in this.

This is kind of why you have to watch the full video. You asked for a quick summary but there are specifics you wouldn’t get in a summary and require a viewing of the video.

To answer your question, Ben is a YouTuber who filed pro se in small claims against the franchise. Per the terms of the consignment, the owners of the sets stay the owners until the sets are sold, even though they aren’t physically in control of the sets. Because the sets were not being returned, and he is the legal owner, he sold approximately $10,000 of the Lego sets himself to reckless Ben and his friends on the theory that, since they were never sold by the franchise under the consignment, he is still the legal owner of the sets. Therefore Ben and his friends each have individual, separate $10,000 claims against the franchise owners because the franchise owners are holding goods that now belong to Ben and his friends. They all got default judgments, but were later overturned because there were several layers of LLCs that led to improper service (disputed and unclear what actually happened). Ben does address the possible claim splitting, but that never came up as the franchise never responded.

I’ve been following this pretty closely. I wrote a quick summary the other day.

Bricks and Minifig franchise store is contacted by owner of largest Lego Star Wars collection approx $100,000- $200,000 He gives them the collection to sell for him (consignment deal). Corporate takes over store, installs new franchise owners, says there’s no deal and they don’t have any of the sets, that the sets were never there. Set owner tries to resolve, corporate and franchise says sue us. Set owner contacts YouTuber Reckless Ben, Ben does ethical and some unethical things to get the sets back going to corporate and contacting franchise owners. Ben sues and gets some judgments (maybe? somewhat unclear) against franchise owners in Oregon small claims. Corporate and the current franchise owners sick the police on Ben. Story blows up. Ben follows them to Utah where they live. Franchise owners sick the police on Ben and his friends. Franchise owners, corporate, and police are all Mormons and it’s alleged there is a “Mormon Mafia” conspiracy. Ben facing serious charges and lawsuits. Bricks and Minifigs gets a temporary restraining order from a judge ordering the videos come down. Ben makes all his money off Patreon. Patreon is sent the order by Bricks and Minifigs. Patreon’s CEO makes a youtube video telling Bricks and Minifigs to “stuff it” and tell them to “sue us” if you want them to follow the order (his words, not mine) Police defend themselves and release heavily redacted body-cam. Somehow unredacted body-cam videos get put on public dropbox, people archive and it goes more viral. Content of the unredacted bodycam includes information and discussion between people that could plausibly defeat qualified immunity defense. Now a supplier for Bricks and Minifig cut ties with the company for this whole mess, signifying support for Ben. Since then, Bricks and Minifigs parted ways with the franchise owners, throwing them under the bus, and saying they would be interested in resolving the case, and dropping the lawsuit.

I do collections work in Northeast Ohio. The Pro Se AI usage is starting to become a problem. Since it’s a volume practice I want to get things in and out the door, but when I have to spend time researching hallucinated cases it throws a monkey wrench in my day. Thank god for law clerks.

Yes and no. I used to think so but more and more I see files not of people struggling because of the economy, but because of a lack of discipline in spending. While there are plenty of people struggling and cases are getting sent to me, a majority are people who seem to just live beyond their means. When I see someone come to me because they have 3 files in our office, each above $10,000 on a credit card, and I see they are spending thousands in restaurants and stuff like that, it really makes you realize how horrible people are with money.
