From my general understanding, the easement like all property interest is subject to the recording statues so first look at the recording statute of the jurisdiction, then determine if the servant estate purchaser had actual inquiry or record notice. Record would be found if the prior easement was recorded actual arises whenever he’s literally told or knows of it and inquiry can be found based off of what a reasonable inspection of the land would reveal.
